AN ACT CONCERNING THE PRESUMPTION OF JOINT CUSTODY 
AND EQUAL SHARED PARENTING TIME IN MATTERS INVOLVING 
THE CARE AND CUSTODY OF A MINOR CHILD. 
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
That subsection (b) of section 46b-56 of the general statutes be 1 
amended to provide that: (1) There shall be a rebuttable presumption 2 
that joint custody and equal shared parenting time is in the best interest 3 
of the child, (2) such presumption may be rebutted by clear and 4 
convincing evidence, and (3) if a deviation from equal parenting time is 5 
warranted, the court shall order a parenting time schedule that 6 
maximizes the time each parent or de facto custodian has with the child 7 
and that is consistent with ensuring the child's welfare. 8 
Statement of Purpose:   
To create a rebuttable presumption of joint custody and equal shared 
parenting time in matters involving the care and custody of a minor 
child.
