18	19		AN ACT CONCERNING THE DEPARTMENT OF PUBLIC HEALTH'S
19	20		RECOMMENDATIONS REGARDING FOOD SAFETY AND ORAL
20	21		HEALTH.
21	22		Be it enacted by the Senate and House of Representatives in General
22	23		Assembly convened:

24	25		Section 1. Section 19a-38 of the general statutes is repealed and the 1
25	26		following is substituted in lieu thereof (Effective from passage): 2
26	27		A water company, as defined in section 25-32a, shall add a measured 3
27	28		amount of fluoride to the water supply of any water system that it owns 4
28	29		and operates and that serves twenty thousand or more persons so as to 5
29	30		maintain an average monthly fluoride content [that is not more or less 6
30	31		than 0.15 of a milligram per liter different than the United States 7
31	32		Department of Health and Human Services' most recent 8
32	33		recommendation for optimal fluoride levels in drinking water to 9
33	34		prevent tooth decay] of 0.7 of a milligram per liter, provided said 10
34	35		average monthly fluoride content shall not deviate greater or less than 11
35	36		0.15 of a milligram per liter. 12
36	37		Sec. 2. Section 19a-36h of the general statutes is repealed and the 13

42	45		(a) Not later than January 1, 2023, the commissioner shall adopt and 15
43	46		administer by reference the United States Food and Drug 16
44	47		Administration's Food Code [, as amended from time to time,] and any 17
45	48		revision thereto issued on or before December 31, 2024. The 18
46	49		commissioner may adopt any Food Code Supplement published by said 19
47	50		administration as the state's food code for the purpose of regulating 20
48	51		food establishments. 21
49	52		(b) The commissioner may adopt regulations, in accordance with the 22
50	53		provisions of chapter 54, to implement the provisions of this section and 23
51	54		sections 19a-36i to 19a-36m, inclusive. 24
