1919 AN ACT PERMITTING A TENANT TO FILE A COMPLAINT WITH A
2020 FAIR RENT COMMISSION WITHIN THIRTY DAYS OF SIGNING A NEW

2222 Be it enacted by the Senate and House of Representatives in General

2525 Section 1. Section 7-148c of the general statutes is repealed and the 1
2626 following is substituted in lieu thereof (Effective July 1, 2025): 2
2727 A tenant may file a complaint with a fair rent commission under this 3
2828 chapter regarding a proposed rental charge increase, either prior to 4
2929 signing a new or amended rental agreement containing such increase or 5
3030 not later than thirty days after signing such rental agreement. In 6
3131 determining whether a rental charge or a proposed increase in a rental 7
3232 charge is so excessive, with due regard to all the circumstances, as to be 8
3333 harsh and unconscionable, a fair rent commission shall consider such of 9
3434 the following circumstances as are applicable to the type of 10
3535 accommodation: (1) The rents charged for the same number of rooms in 11
3636 other housing accommodations in the same and in other areas of the 12
3737 municipality; (2) the sanitary conditions existing in the housing 13
3838 accommodations in question; (3) the number of bathtubs or showers, 14

4545 flush water closets, kitchen sinks and lavatory basins available to the 15
4646 occupants thereof; (4) services, furniture, furnishings and equipment 16
4747 supplied therein; (5) the size and number of bedrooms contained 17
4848 therein; (6) repairs necessary to make such accommodations reasonably 18
4949 livable for the occupants accommodated therein; (7) the amount of taxes 19
5050 and overhead expenses, including debt service, thereof; (8) whether the 20
5151 accommodations are in compliance with the ordinances of the 21
5252 municipality and the general statutes relating to health and safety; (9) 22
5353 the income of the petitioner and the availability of accommodations; (10) 23
5454 the availability of utilities; (11) damages done to the premises by the 24
5555 tenant, caused by other than ordinary wear and tear; (12) the amount 25
5656 and frequency of increases in rental charges; and (13) whether, and the 26
5757 extent to which, the income from an increase in rental charges has been 27
5858 or will be reinvested in improvements to the accommodations. 28
5959 This act shall take effect as follows and shall amend the following
