1219 AN ACT CONCERNING EQUITABLE COMPENSATION FOR STATE -
1320 CONTRACTED NONPROFIT HUMAN SERVICES PROVIDERS.
1421 Be it enacted by the Senate and House of Representatives in General

17-Section 1. (NEW) (Effective from passage) (a) As used in this section, (1) 1
18-"nonprofit human services provider" means a nonprofit provider that 2
19-contracts with the state to provide human services that may include, but 3
20-need not be limited to: (A) Services for persons with a physical 4
21-disability, (B) services for persons with intellectual disability or 5
22-developmental disabilities, including, but not limited to, autism 6
23-spectrum disorder, and (C) behavioral health services; and (2) "state 7
24-agency" has the same meaning as provided in section 4-37e of the 8
25-general statutes. 9
26-(b) On July first annually, a state agency contracting with a nonprofit 10
27-human services provider shall increase rates for recurring contracts by 11
28-the percentage increase in the consumer price index for all urban 12
29-consumers in the northeast region in the previous calendar year. If such 13
30-consumer price index decreases, a state agency shall not decrease rates 14
31-for such provider. 15
32-(c) On July first annually, the Commissioner of Social Services shall 16
33-adjust Medicaid rates for nonprofit human services providers 17
34-contracting with the Department of Social Services by the percentage 18 Substitute Bill No. 1358
24+Section 1. (NEW) (Effective from passage) (a) As used in this section and 1
25+section 2 of this act, (1) "nonprofit human services provider" means a 2
26+nonprofit entity that contracts with the state to provide health and 3
27+human services that may include, but need not be limited to: (A) 4
28+Services for persons with a physical disability, (B) services for persons 5
29+with intellectual disability or developmental disabilities, including, but 6
30+not limited to, autism spectrum disorder, and (C) behavioral health 7
31+services; and (2) "purchase of service contract" and "state agency" have 8
32+the same meanings as provided in section 4-70b of the general statutes, 9
33+as amended by this act. 10
34+(b) Not later than January 1, 2026, and every five years thereafter, the 11
35+Secretary of the Office of Policy and Management shall, in consultation 12
36+with representatives of nonprofit human services providers, complete a 13
37+review of a portion of the state's purchase of service contracts and 14
38+personal service agreements with nonprofit human services providers 15

39-rate increase, if any, for state agency contracts pursuant to subsection 19
40-(b) of this section, unless such adjustment is not permissible under 20
41-federal law governing the Medicaid program. 21
42-(d) Not later than January 1, 2026, and every three years thereafter, 22
43-the Secretary of the Office of Policy and Management shall file a report, 23
44-in accordance with the provisions of section 11-4a of the general statutes, 24
45-with the joint standing committees of the General Assembly having 25
46-cognizance of matters relating to appropriations and the budgets of state 26
47-agencies, human services and public health on state agency contracts 27
48-with nonprofit human services providers. The report shall include, but 28
49-need not be limited to, any appropriations needed to ensure that rates 29
50-for all such contracts in subsequent fiscal years include any increase in 30
51-the consumer price index for all urban consumers in the northeast 31
52-region in the previous calendar year. 32

45+to determine whether the rates such providers are paid to deliver health 16
46+and human services pursuant to such contracts or agreements 17
47+adequately compensate such providers for providing the level of 18
48+services expected by the state agency contracting with such provider. 19
49+For purposes of such review, the secretary shall examine the contracts 20
50+and agreements for such services of not less than two state agencies each 21
51+year. 22
52+(c) Not later than February 1, 2026, and every five years thereafter, 23
53+the secretary shall submit a report, in accordance with the provisions of 24
54+section 11-4a of the general statutes, to the joint standing committees of 25
55+the General Assembly having cognizance of matters relating to human 26
56+services, government administration and appropriations and the 27
57+budgets of state agencies. Such report shall include (1) a summary of the 28
58+results of the review conducted under subsection (b) of this section, (2) 29
59+any applicable recommendations concerning requiring contracting state 30
60+agencies to reduce contractual expectations if those expectations are not 31
61+adequately funded by the contract or agreement, and (3) any 32
62+recommended legislation necessary to implement such 33
63+recommendations. 34
64+Sec. 2. (NEW) (Effective from passage) (a) Not later than January 1, 2026, 35
65+and triennially thereafter, the Secretary of the Office of Policy and 36
66+Management shall conduct a review of any reports that nonprofit 37
67+human services providers are required to file with various state 38
68+agencies. Such review shall include, but not be limited to, looking at the 39
69+number of reports that are required to be filed, the amount of 40
70+overlapping information in such reports, the time and resources needed 41
71+for providers to prepare and file the reports, the reasons for requiring 42
72+such reports and an analysis of how the reports are utilized by the state 43
73+agency receiving such reports. State agencies and nonprofit human 44
74+services providers shall provide any information requested by the 45
75+secretary for purposes of such review. 46
76+(b) The secretary shall eliminate or consolidate any reporting 47

83+required by a state agency that the secretary identifies under subsection 48
84+(a) of this section as unduly burdensome or duplicative, unless such 49
85+reporting is (1) necessary to prevent fraud or misuse of funds, (2) 50
86+prescribed under federal law or regulation for the use of federal funds, 51
87+or (3) required under any provision of state law. 52
88+(c) Not later than February 1, 2026, and triennially thereafter, the 53
89+secretary shall submit a report, in accordance with the provisions of 54
90+section 11-4a of the general statutes, to the joint standing committees of 55
91+the General Assembly having cognizance of matters relating to human 56
92+services, government administration and appropriations and the 57
93+budgets of state agencies. Such report shall include a summary of the 58
94+results of the review conducted under subsection (a) of this section, any 59
95+reporting eliminated or consolidated under subsection (b) of this section 60
96+and any recommendations for any legislation necessary to eliminate 61
97+burdensome or duplicative reporting requirements required under state 62
98+law. 63
99+Sec. 3. Subsection (d) of section 4-70b of the general statutes is 64
100+repealed and the following is substituted in lieu thereof (Effective July 1, 65
101+2025): 66
102+(d) The secretary shall establish uniform policies and procedures for 67
103+obtaining, managing and evaluating the quality and cost effectiveness 68
104+of direct health and human services purchased from a private provider 69
105+organization or municipality. Such policies and procedures shall 70
106+include, but need not be limited to, a requirement that a private provider 71
107+organization receive payment for any services provided pursuant to a 72
108+purchase of service contract not later than thirty days after delivery of 73
109+such services. The secretary shall require all state agencies which 74
110+purchase direct health and human services to comply with such policies 75
111+and procedures. 76
