LCO 1 of 3 General Assembly Substitute Bill No. 1380 January Session, 2025 AN ACT PROHIBITING DISCRIMINATION BY HEALTH CARE PROVIDERS IN THE PROVISION OF HEALTH CARE SERVICES IN THE STATE. Be it enacted by the Senate and House of Representatives in General Assembly convened: Section 1. (NEW) (Effective October 1, 2025) It shall be a discriminatory 1 practice in violation of this section for any health care provider to 2 knowingly discriminate in the provision of health care services on 3 account of a person's race, color, religious creed, sex, gender identity or 4 expression, sexual orientation, marital status, age, national origin, 5 ancestry, intellectual disability, mental disability, learning disability, 6 physical disability, including, but not limited to, blindness, status as a 7 veteran or status as a victim of domestic violence. As used in this section, 8 "health care provider" means any person, corporation, facility or 9 institution licensed by this state to provide health care services, or an 10 officer, employee or agent thereof acting in the course and scope of such 11 person's employment. Nothing in this section shall be construed to (1) 12 require the delivery of futile health care and services in conflict with a 13 health care provider's professional judgment or ethical considerations, 14 (2) affect the professional standard of care, or (3) interfere with public 15 health planning. 16 Sec. 2. Subdivision (8) of section 46a-51 of the general statutes is 17 repealed and the following is substituted in lieu thereof (Effective October 18 Substitute Bill No. 1380 LCO 2 of 3 1, 2025): 19 (8) "Discriminatory practice" means a violation of section 4a-60, 4a-20 60a, 4a-60g, 19a-498c, 31-40y, subsection (b), (d), (e) or (f) of section 31-21 51i, subparagraph (C) of subdivision (15) of section 46a-54, subdivisions 22 (16) and (17) of section 46a-54, section 46a-58, 46a-59, 46a-60, 46a-64, 46a-23 64c, 46a-66 or 46a-68, sections 46a-68c to 46a-68f, inclusive, sections 46a-24 70 to 46a-78, inclusive, subsection (a) of section 46a-80, sections 46a-81b 25 to 46a-81o, inclusive, sections 46a-80b to 46a-80e, inclusive, sections 46a-26 80k to 46a-80m, inclusive, or section [19a-498c] 1 of this act; 27 Sec. 3. Subsection (f) of section 46a-82 of the general statutes is 28 repealed and the following is substituted in lieu thereof (Effective October 29 1, 2025): 30 (f) (1) Any complaint filed pursuant to this section for an alleged act 31 of discrimination that occurred prior to October 1, 2021, shall be filed 32 within one hundred and eighty days after the date of the alleged act of 33 discrimination, except that any complaint by a person (A) claiming to 34 be aggrieved by a violation of subsection (a) of section 46a-80 that 35 occurred before October 1, 2019, shall be filed within thirty days of the 36 date of the alleged act of discrimination, and (B) claiming to be 37 aggrieved by a violation of section 46a-60, sections 46a-70 to 46a-78, 38 inclusive, or section 46a-80 or 46a-81c, that occurred on or after October 39 1, 2019, and prior to October 1, 2021, shall be filed not later than three 40 hundred days after the date of the alleged act of discrimination. 41 (2) Any complaint filed pursuant to this section for an alleged act of 42 discrimination that occurred on or after October 1, 2021, shall be filed 43 [within] not later than three hundred days after the date of the alleged 44 act of discrimination, except that any complaint by a person claiming to 45 be aggrieved by a violation of section 1 of this act shall be filed not later 46 than three years after the date of the alleged act of discrimination. 47 This act shall take effect as follows and shall amend the following sections: Substitute Bill No. 1380 LCO 3 of 3 Section 1 October 1, 2025 New section Sec. 2 October 1, 2025 46a-51(8) Sec. 3 October 1, 2025 46a-82(f) JUD Joint Favorable Subst.
