AN ACT MODIFYING THE REGULATORY FLEXIBILITY ANALYSIS OF 
REGULATIONS AFFECTING SMALL BUSINESSES.  
Be it enacted by the Senate and House of Representatives in General 
Assembly convened: 
 
Section 1. Subsection (b) of section 4-168a of the general statutes is 1 
repealed and the following is substituted in lieu thereof (Effective July 1, 2 
2025): 3 
(b) Prior to or concomitant with the posting of a notice pursuant to 4 
section 4-168, each agency shall prepare a regulatory flexibility analysis 5 
in which the agency shall identify: 6 
(1) The scope and objectives of the proposed regulation; 7 
(2) The types of businesses potentially affected by the proposed 8 
regulation; 9 
(3) The total number of small businesses potentially subject to the 10 
proposed regulation; 11 
(4) Whether small businesses, in order to comply with the proposed 12 
regulation, may be required to: (A) Create, file or issue additional 13 
reports; (B) implement additional recordkeeping procedures, including, 14 
but not limited to, the retention of records for a period of time; (C) 15 
provide additional administrative oversight; (D) hire additional 16  Substitute Bill No. 1402

employees; (E) hire or contract with additional professionals, including, 17 
but not limited to, lawyers, accountants, engineers, auditors or 18 
inspectors; (F) purchase any product or make any capital investment; 19 
(G) conduct additional training, audits or inspections; [or] (H) pay 20 
additional taxes or fees; (I) modify or provide an additional employee 21 
benefit; or (J) modify a product manufactured by the small business or 22 
the packaging of such product; 23 
(5) Whether and to what extent the agency communicated with small 24 
businesses or small business organizations in developing the proposed 25 
regulation and the regulatory flexibility analysis, if applicable; 26 
(6) Whether and to what extent the proposed regulation provides 27 
alternative compliance methods for small businesses that will 28 
accomplish the objectives of applicable statutes while minimizing 29 
adverse impact on small businesses. Such methods shall be consistent 30 
with public health, safety and welfare and may include, but not be 31 
limited to: 32 
(A) The establishment of less stringent compliance or reporting 33 
requirements for small businesses; 34 
(B) The establishment of less stringent schedules or deadlines for 35 
compliance or reporting requirements for small businesses; 36 
(C) The consolidation or simplification of compliance or reporting 37 
requirements for small businesses; 38 
(D) The establishment of performance standards for small businesses 39 
to replace design or operational standards required in the proposed 40 
regulation; and 41 
(E) The exemption of small businesses from all or any part of the 42 
requirements contained in the proposed regulation. 43 
This act shall take effect as follows and shall amend the following 
sections:
