1219 AN ACT MODIFYING THE REGULATORY FLEXIBILITY ANALYSIS OF
1320 REGULATIONS AFFECTING SMALL BUSINESSES.
1421 Be it enacted by the Senate and House of Representatives in General
1522 Assembly convened:

1724 Section 1. Subsection (b) of section 4-168a of the general statutes is 1
1825 repealed and the following is substituted in lieu thereof (Effective July 1, 2
1926 2025): 3
2027 (b) Prior to or concomitant with the posting of a notice pursuant to 4
2128 section 4-168, each agency shall prepare a regulatory flexibility analysis 5
2229 in which the agency shall identify: 6
2330 (1) The scope and objectives of the proposed regulation; 7
2431 (2) The types of businesses potentially affected by the proposed 8
2532 regulation; 9
2633 (3) The total number of small businesses potentially subject to the 10
2734 proposed regulation; 11
2835 (4) Whether small businesses, in order to comply with the proposed 12
2936 regulation, may be required to: (A) Create, file or issue additional 13

3043 reports; (B) implement additional recordkeeping procedures, including, 14
3144 but not limited to, the retention of records for a period of time; (C) 15

45+provide additional administrative oversight; (D) hire additional 16
3746 employees; (E) hire or contract with additional professionals, including, 17
3847 but not limited to, lawyers, accountants, engineers, auditors or 18
3948 inspectors; (F) purchase any product or make any capital investment; 19
40-(G) conduct additional training, audits or inspections; [or] (H) pay 20
41-additional taxes or fees; (I) modify or provide an additional employee 21
42-benefit; or (J) modify a product manufactured by the small business or 22
43-the packaging of such product; 23
44-(5) Whether and to what extent the agency communicated with small 24
45-businesses or small business organizations in developing the proposed 25
46-regulation and the regulatory flexibility analysis, if applicable; 26
47-(6) Whether and to what extent the proposed regulation provides 27
48-alternative compliance methods for small businesses that will 28
49-accomplish the objectives of applicable statutes while minimizing 29
50-adverse impact on small businesses. Such methods shall be consistent 30
51-with public health, safety and welfare and may include, but not be 31
52-limited to: 32
53-(A) The establishment of less stringent compliance or reporting 33
54-requirements for small businesses; 34
55-(B) The establishment of less stringent schedules or deadlines for 35
56-compliance or reporting requirements for small businesses; 36
57-(C) The consolidation or simplification of compliance or reporting 37
58-requirements for small businesses; 38
59-(D) The establishment of performance standards for small businesses 39
60-to replace design or operational standards required in the proposed 40
61-regulation; and 41
62-(E) The exemption of small businesses from all or any part of the 42
63-requirements contained in the proposed regulation. 43
