56 | 59 | | contractor in the electrical, plumbing, heating, piping and cooling, 9 |

57 | 60 | | sprinkler fitter or sheet metal work trades to hire one or more additional 10 |

58 | 61 | | apprentices even if the licensed contractor does not employ a sufficient 11 |

59 | 62 | | number of licensees to satisfy the applicable allowing hiring ratio 12 |

60 | 63 | | established in the regulations amended pursuant to subsection (a) of this 13 |

61 | 64 | | section, provided: 14 |

62 | 65 | | (A) The licensed contractor submits an application to the Department 15 |
---|
63 | 66 | | of Consumer Protection, in a form and manner prescribed by the 16 |
---|
64 | 67 | | commissioner, for each such apprentice, which application shall (i) 17 |
---|
65 | 68 | | disclose the name of the licensed contractor and the name of the 18 |
---|
66 | 69 | | apprentice, (ii) demonstrate that good cause exists for the commissioner 19 |
---|
67 | 70 | | to allow the licensed contractor to hire the apprentice, and (iii) include 20 |
---|
68 | 71 | | any other information the commissioner, in the commissioner's 21 |
---|
69 | 72 | | discretion, deems relevant for the purposes of this subsection; and 22 |
---|
70 | 73 | | (B) The commissioner determines, after reviewing the application 23 |
---|
71 | 74 | | submitted pursuant to subparagraph (A) of this subdivision and in the 24 |
---|
72 | 75 | | commissioner's discretion, that good cause exists for the commissioner 25 |
---|
73 | 76 | | to allow the licensed contractor to hire the apprentice. 26 |
---|
74 | 77 | | (2) Not later than ten business days after a licensed contractor 27 |
---|
75 | 78 | | submits an application to the Commissioner of Consumer Protection 28 |
---|
76 | 79 | | pursuant to subparagraph (A) of subdivision (1) of this subsection, the 29 |
---|
82 | 87 | | application, (B) determine whether good cause exists for the 31 |
---|
83 | 88 | | commissioner to allow the licensed contractor to hire the apprentice, 32 |
---|
84 | 89 | | and (C) send notice to the licensed contractor, in a form and manner 33 |
---|
85 | 90 | | prescribed by the commissioner, disclosing the commissioner's 34 |
---|
86 | 91 | | determination regarding whether good cause exists for the 35 |
---|
87 | 92 | | commissioner to allow the licensed contractor to hire the apprentice. 36 |
---|
88 | 93 | | (3) If the Commissioner of Consumer Protection does not send notice 37 |
---|
89 | 94 | | to the licensed contractor within the ten-business-day period 38 |
---|
90 | 95 | | established in subdivision (2) of this subsection, the licensed contractor's 39 |
---|
91 | 96 | | application shall be deemed to have been approved by the 40 |
---|
92 | 97 | | commissioner. 41 |
---|
93 | 98 | | (4) The Commissioner of Consumer Protection may, in accordance 42 |
---|
94 | 99 | | with the provisions of chapter 54, amend any regulations adopted 43 |
---|
95 | 100 | | pursuant to section 20-332 and amended pursuant to subsection (a) of 44 |
---|
96 | 101 | | this section for the purposes of this subsection. 45 |
---|
97 | 102 | | This act shall take effect as follows and shall amend the following |
---|
