AN ACT CONVEYING PARCELS OF STATE LAND KNOWN AS CAMP
BROOK GREENWAY IN THE TOWN OF NORTH CANAAN.
Be it enacted by the Senate and House of Representatives in General
Assembly convened:
Section 1. (Effective from passage) (a) Notwithstanding any provision 1
of the general statutes, the Commissioner of Transportation shall convey 2
to the town of North Canaan four parcels of land located in the town of 3
North Canaan, at a cost equal to the administrative costs of making such 4
conveyance. Said parcels of land have an area of approximately 27.45 5
acres and are identified as "Release Area=27.45 Acres" on a map entitled 6
"Compilation Plan, Town of North Canaan, Map Showing Land 7
Released to , By The State of Connecticut, Department of 8
Transportation, U.S. Route 7 (Ashley Falls Road) & Granger Lane, Scale 9
1"-120', October 2021, Scott A. Hill, P.E., Chief Engineer Bureau of 10
Engineering and Construction" and are further identified as a portion of 11
Lots 041-0, 048-0 and 049-0 on town of North Canaan's Tax Assessor's 12
Map 29 and a portion of Lot 330-0 on town of North Canaan's Tax 13
Assessor's Map 22. The conveyance shall be subject to the approval of 14
the State Properties Review Board. 15

(b) The town of North Canaan shall use said parcels of land for open 16
space or low impact nonmotorized passive public recreation purposes, 17
including, but not limited to, a greenway trail and disc golf. If the town 18
of North Canaan: 19
(1) Does not use said parcels for any of said purposes; 20
(2) Does not retain ownership of all of said parcels, other than a 21
transfer or sale to a nonprofit entity to facilitate or manage said 22
purposes; or 23
(3) Leases all or any portion of said parcels, other than a lease to a 24
nonprofit entity to facilitate or manage said purposes, 25
the parcels shall revert to the state of Connecticut. Any funds received 26
by the town of North Canaan from a sale or lease of said parcels to a 27
nonprofit entity under this subsection shall be transferred to the State 28
Treasurer for deposit in the General Fund. 29
(c) The State Properties Review Board shall complete its review of the 30
conveyance of said parcels of land not later than thirty days after it 31
receives a proposed agreement from the Department of Transportation. 32
The land shall remain under the care and control of said department 33
until a conveyance is made in accordance with the provisions of this 34
section. The State Treasurer shall execute and deliver any deed or 35
instrument necessary for a conveyance under this section, which deed 36
or instrument shall include provisions to carry out the purposes of 37
subsection (b) of this section. The Commissioner of Transportation shall 38
have the sole responsibility for all other incidents of such conveyance. 39
This act shall take effect as follows and shall amend the following
sections:

Statement of Purpose:
To convey parcels of state land known as Camp Brook Greenway in the
town of North Canaan to said town.
