To order the closing of portions of an existing public alley system in Squares 3841 and 3846; to 14 
order the closing of a 10-foot-wide portion along the south side of Franklin Street, N.E., 15 
between Reed Street, N.E. and 10

 Street, N.E., and to accept the dedication of property 16 
in Squares 3841 and 3846 along the west and east sides of Reed Street, N.E., between 17 
Channing Place, N.E. and Franklin Street, N.E., for public alley purposes. 18

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 20 
act may be cited as the “Reed Street Realignment Act of 2023”. 21 
Sec. 2. (a) Pursuant to Section 201 of the Street and Alley Closing and Acquisition 22 
Procedures Act of 1982, effective March 10, 1983 (D.C. Law 4-201; D.C. Official Code § 9-23 
202.01, et seq.) (the “Act”),  the Council of the District of Columbia finds the portions of the 24 
public alley system in Square 3841 and 3846 and the 10-foot-wide portion along the south side 25 
of Franklin Street, N.E., as shown on the Surveyor’s plat in S.O. 22-01115, are unnecessary for 26 
street or alley purposes and orders them closed with title to the land to vest as shown on the 27 
Surveyor’s plat.   28 
(b) Pursuant to Sections 301 and 401 of the Act (D.C. Official Code §§ 9-203.01, et seq. 29 
and 9-204.01), and notwithstanding the requirements set forth in Sections 403 and 421 of the Act 30 
(D.C. Official Code §§ 9-204.03 and 9-204.21), the Council accepts the dedication of property in 31

Squares 3841 and 3846 for public alley purposes, and designates the dedicated alley as a portion 32 
of Reed Street, N.E., as shown on the Surveyor’s plat filed under S.O. 22-01115.  33 
Sec. 3. The ordering of the street and alley closings and acceptance of the land 34 
dedications specified in section 2 are contingent upon the satisfaction of all the conditions set 35 
forth in the official file for S.O. 22-01115. If construction on the newly dedicated alley 36 
established herein is not commenced in accordance with the timeframe set forth in the official 37 
file for S.O. 22-01115, the closings and dedications approved herein shall terminate and the 38 
rights of way existing as of the effective date of this Reed Street Realignment Act shall be 39 
reinstated. 40 
Sec. 4. Notwithstanding any other provision of law, the District Department of 41 
Transportation shall waive the public space inconvenience fee relating to occupancy permits, or 42 
other related permit fees, for use of the newly established Reed Street, following acceptance of 43 
the same, for construction of the Phase II-A and Phase II-B properties and for completion of the 44 
Reed Street Infrastructure Improvements, all as defined in the official file for S.O. 22-01115.   45 
Sec. 5. Fiscal impact statement. 46 
The Council adopts the fiscal impact statement in the committee report as required by 47 
section 4a of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 48 
Stat. 2038; D.C. Official Code § 1-301.47a). 49 
Sec. 6. Effective date. 50 
This act shall take effect following approval by the Mayor (or in the event of veto by the 51 
Mayor, action by the Council to override the veto), a 30-day period of congressional review as 52 
provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 53

24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of 54 
Columbia Register. 55
