19-to accept the dedication of property in Squares 3841 and 3846, along the west and east
20-sides of Reed Street, NE, between Channing Place, NE, and Franklin Street, NE, for

23-BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
24-act may be cited as the “Reed Street Realignment Act of 2023”.

26-Sec. 2. (a) Pursuant to section 201 of the Street and Alley Closing and Acquisition
27-Procedures Act of 1982, effective March 10, 1983 (D.C. Law 4-201; D.C. Official Code § 9-
28-202.01) ( “Act”), the Council finds that portions of the public alley system in Square 3841 and
29-3846 and the 10-foot-wide portion along the south side of Franklin Street, NE, as shown on the
30-Surveyor’s plat in S.O. 22-01115, are unnecessary for street or alley purposes and orders them
31-closed with title to the land to vest as shown on the Surveyor’s plat.
32-(b) Pursuant to sections 301 and 401 of the Act (D.C. Official Code §§ 9-203.01 and 9-
33-204.01), and notwithstanding the requirements set forth in sections 403 and 421 of the Act (D.C.
34-Official Code §§ 9-204.03 and 9-204.21), the Council accepts the dedication of property in
35-Squares 3841 and 3846 for public alley purposes and designates the dedicated alley as a portion
36-of Reed Street, NE, as shown on the Surveyor’s plat filed under S.O. 22-01115.

38-Sec. 3. (a) The ordering of the street and alley closings and acceptance of the land
39-dedications specified in section 2 are contingent upon the satisfaction of all the conditions set
40-forth in the official file for S.O. 22-01115.
41- (b) If construction on the newly dedicated alley established herein is not commenced in
42-accordance with the timeframe set forth in the official file for S.O. 22-01115, the closings and
43-dedications approved herein shall terminate and the rights of way existing as of the effective date
44-of this act shall be reinstated.

25+BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 16
26+act may be cited as the “Reed Street Realignment Act of 2023”. 17

52-Sec. 4. Notwithstanding any other provision of law, the District Department of
53-Transportation shall waive the public space inconvenience fee relating to occupancy permits or
54-other related permit fees for use of the newly established Reed Street, NE, following acceptance
55-of the same, for construction of the Phase II-A and Phase II-B properties and for completion of
56-the Reed Street Infrastructure Improvements, all as defined in the official file for S.O. 22-01115.

58-Sec. 5. Fiscal impact statement.
59-The Council adopts the fiscal impact statement in the committee report as the fiscal
60-impact statement required by section 4a of the General Legislative Procedures Act of 1975,
61-approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

63-Sec. 6. Effective date.
64-This act shall take effect following approval by the Mayor (or in the event of veto by the
65-Mayor, action by the Council to override the veto), a 30-day period of congressional review as
66-provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December
67-24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of
68-Columbia Register.
