14+This contract arranges outside legal counsel from Outten & Golden to assist OAG with complex
15+litigation against Power Design, Inc. and related codefendants for violating the District’s wage-and-
16+hour
17+ laws. The contract is a definitive multi-year, contingency-fee contract with a not-to-exceed
18+contract amount of $55 million. The base period of performance is from the date of award through
19+five years thereafter. This contract will definitize a letter contract awarded on December 16,2022.
20+Enclosed for consideration and approval by the Council of the District of Columbia is proposed
21+emergency legislation (“Contract No. DCCB-2023-F-0015 with Outten & Golden LLP Approval
22+and Payment Authorization Emergency Act of 2023”) and an accompanying emergency
23+declaration resolution to approve a multi-year contract between the Office of the Attorney General
24+(OAG) and Outten & Golden LLP.

33+BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
34+act may be cited as the “Contract No. DCCB-2023-F-0015 with Outten & Golden LLP Approval22
35+and Payment Authorization Emergency Act of 2023”.23
36+Sec. 2. Pursuant to section 451 of the District of Columbia Home Rule Act, approved24
37+December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51), and section 202 of the25
38+Procurement Practices Reform Act of 2010, effective April 8, 2011 (D.C. Law 18-371; D.C.26
39+Official Code § 2-352.02), the Council approves multiyear Contract No. DCCB-2023-F-001527
40+with Outten & Golden LLP, to provide legal services to the Office of the Attorney General for a28
41+wage and hour matter, and authorizes payment in the not-to-exceed amount of $55 million for29

20- BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
21-act may be cited as the “Contract No. DCCB-2023-F-0015 with Outten & Golden LLP Approval
22-and Payment Authorization Emergency Act of 2023”.

24-Sec. 2. Pursuant to section 451 of the District of Columbia Home Rule Act, approved
25-December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51), and notwithstanding section
26-202 of the Procurement Practices Reform Act of 2010, effective April 8, 2011 (D.C. Law 18-
27-371; D.C. Official Code § 2-352.02), the Council approves multiyear Contract No. DCCB-2023-
28-F-0015 with Outten & Golden LLP to provide legal services to the Office of the Attorney
29-General for a wage and hour matter and authorizes payment in the not-to-exceed amount of $55
30-million for the goods and services received and to be received under the contract.

32-Sec. 3. Fiscal impact statement.
33-The Council adopts the fiscal impact statement of the Chief Financial Officer as the fiscal
34-impact statement required by section 4a of the General Legislative Procedures Act of 1975,
35-approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

37-Sec. 4. Effective date.
38-This act shall take effect following approval by the Mayor (or in the event of veto by the
39-Mayor, action by the Council to override the veto), and shall remain in effect for no longer than
40-90 days, as provided for emergency acts of the Council of the District of Columbia in
