23- BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
24-act may be cited as the “Contract No. GAGA-2022-C-0186 with Tamah, LLC Approval and
25-Payment Authorization Emergency Act of 2023”.

27-Sec. 2. Pursuant to section 451 of the District of Columbia Home Rule Act, approved
28-December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51), and notwithstanding the
29-requirements of section 202 of the Procurement Practices Reform Act of 2010, effective April 8,
30-2011 (D.C. Law 18-371; D.C. Official Code § 2-352.02), the Council approves Contract No.
31-GAGA-2022-C-0186 with Tamah, LLC and Modification Nos. 02, 01, 2, 03, 04, 05, and 06
32-thereto, to provide dedicated aides and nurses to the District of Columbia Public Schools, and
33-authorizes payment in the not-to-exceed amount of $1,798,725.50 for the goods and services
34-received from June 27, 2022 through September 30, 2022 and payment in the not-to-exceed
35-amount of $4,551,238.50 for goods and services received and to be received from October 1,
36-2022 through September 30, 2023.

38- Sec. 3. Fiscal impact statement.
39-The Council adopts the fiscal impact statement of the Chief Financial Officer as the fiscal
40-impact statement required by section 4a of the General Legislative Procedures Act of 1975,
41-approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

172+35% certified business· enterprise subcontracting requirement. Three bidders responded by the
173+closing date
174+of June 23, 2022. The contracting officer awarded the contract on June 27, 2022 to

176+as the lowest-priced responsive and responsible bidder.

194+charter schools. Through those relationships, the contractor has partnered with over 1,000
195+instructional paraprofessionals, nurses, and teachers to work with over 900 individual children and
196+their families.
197+The contractor has demonstrated through past performance that their organization has the history,
198+personnel, and organizational and technical experience required to meet successfully the contract
199+requirements. Likewise, the contractor maintains the financial resources, accounting, and
200+operational controls to fulfill DCPS's requirements. The contractor has been deemed responsible
201+in
202+accordance with DCPS' s standards for responsibility.

245+There were multiple factors resulting in the awarding of the contract actions prior to submission to
246+the
247+Council. The main factor was that DCPS experienced increased rates of vacancies and
248+turnovers in key staff, including the ch ief contracting officer positio n. This factor, along with the
249+decentralized administrative structure
250+of DCPS's contracting function, resulted in a failure to
251+3 request and obtain Council approval before the contract actions were implemented. DCPS regrets
252+this failure and
253+is working to update and improve its processes and procedures and determine
254+appropriate administrative actions to be taken in response to the failure.
255+(L) The reason for the proposed change:
256+The contracting officer awarded the initial contract and continued with the exercise of option year
257+one so that DCPS could provide during the school day critical services dedicated to specific
258+students with disabilities. The contractor provides dedicated aides and nurses to ensure that
259+services and support are provided to students with disabilities who require them to access the
260+curriculum and make meaningful program toward identified educational goals and objectives.
