1 ___________________________ 1 Councilmember Trayon White Sr. 2 3 4 A BILL 5 6 _________________ 7 8 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 9 10 ______________ 11 12 To require, on an emergency basis, the District Department of Transportation to remove three 13 trees located near the property line of 450 Xenia Street S.E., in Ward 8. 14 15 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 16 act may be cited as the “Xenia Street Tree Removal Emergency Act of 2023”. 17 Sec. 2. Notwithstanding the prohibition in Section 2 of the Tree Protection Amendment 18 Act of 2000, effective June 19, 2001 (D.C. Law 13-314; D.C. Official Code § 10-731) or any 19 other provision of law, the District Department of Transportation shall remove the three trees 20 located on or near the property line and walkway of 450 Xenia Street S.E. no later than July 6, 21 2023. 22 Sec. 3. Fiscal impact statement. 23 The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact 24 statement required by section 4a of the General Legislative Procedures Act of 1975, approved 25 October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 26 Sec. 4. Effective date. 27 This act shall take effect following approval by the Mayor (or in the event of veto by the 28 Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 29 90 days, as provided for emergency acts of the Council of the District of Columbia in section 30 2 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; 31 D.C. Official Code § 1-204.12(a)). 32
