1414 To require, on an emergency basis, the District Department of Transportation to remove three 13
1515 trees located near the property line of 450 Xenia Street S.E., in Ward 8. 14

1717 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 16
1818 act may be cited as the “Xenia Street Tree Removal Emergency Act of 2023”. 17
1919 Sec. 2. Notwithstanding the prohibition in Section 2 of the Tree Protection Amendment 18
2020 Act of 2000, effective June 19, 2001 (D.C. Law 13-314; D.C. Official Code § 10-731) or any 19
2121 other provision of law, the District Department of Transportation shall remove the three trees 20
2222 located on or near the property line and walkway of 450 Xenia Street S.E. no later than July 6, 21
2323 2023. 22
2424 Sec. 3. Fiscal impact statement. 23
2525 The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact 24
2626 statement required by section 4a of the General Legislative Procedures Act of 1975, approved 25
2727 October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 26
2828 Sec. 4. Effective date. 27
2929 This act shall take effect following approval by the Mayor (or in the event of veto by the 28
3030 Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 29
3131 90 days, as provided for emergency acts of the Council of the District of Columbia in section 30 2
3232 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; 31
3333 D.C. Official Code § 1-204.12(a)). 32
