22- BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
23-act may be cited as the “Modification Nos. 10 and 11 to Contract NFPHC-NSD-21-C-00027
24-with Maxim Healthcare Staffing Approval and Payment Authorization Emergency Act of 2023”.

26- Sec. 2. Pursuant to section 451 of the District of Columbia Home Rule Act, approved
27-December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51), and notwithstanding the
28-requirements of section 202 of the Procurement Practices Reform Act of 2010, effective April 8,
29-2011 (D.C. Law 18-371; D.C. Official Code § 2-352.02), the Council approves Modification
30-Nos. 10 and 11 to Contract NFPHC-NSD-21-C-00027 with Maxim Healthcare to provide nurse
31-staffing services for the emergency department, intensive care unit, and telemetry services and
32-authorizes payment in the not-to-exceed amount of $5,125,000 for the services received and to
33-be received under the contract.

35- Sec. 3. Fiscal impact statement.
36-The Council adopts the fiscal impact statement of the Chief Financial Officer as the fiscal
37-impact statement required by section 4a of the General Legislative Procedures Act of 1975,
38-approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

40-Sec. 4. Effective date.
41-This act shall take effect following approval by the Mayor (or in the event of veto by the
42-Mayor, action by the Council to override the veto), and shall remain in effect for no longer than
43-90 days, as provided for emergency acts of the Council of the District of Columbia in section

28+Year 2 Modification 10 (in the amount of $925,000.00 for a period of December 10, 2022
29+through February 7, 2023) and Proposed Modification 11 (in the amount of $4,200,000.00
30+for a period of February 8, 2023 through December 9, 2023) because when combined, the
31+total retroactive contract value of Option Year 2 would be $5,125,000.00 for a 12-month
32+period of December 10, 2022 to December 9, 2023. Continued approval is vital to avoiding
33+a major disruption in these services. The unavoidable retroactivity, which was discussed
34+during recent oversight hearings, is due to constantly increasing nurse agency costs,
35+extended time needed to negotiate financial terms, nationwide industry shortages, current
36+hospital staffing needs, and the pending wind down.

342+wind down. Unfortunately, previous attempts to contract with DSLBD's CBEs did not yield
343+qualified staff and the Hospital's clinical needs could not wait. Despite these difficulties, UMC
344+remains undeterred in its efforts to create and maintain opportunities for small, local, and
345+disadvantaged businesses at UMC across all areas
346+of the hospital and looks forward to continuing to
347+work with DSLBD and the community to improve.

349+The Contractor's performance will be monitored by the Not-for-Profit Hospital Corporation
