To, on an emergency basis, order the closing of a portion of an alley in Square 2873 abutting 15 
Lots 1106 and 1112 in Ward 1, to establish a 25	-foot wide building restriction line on the 16 
closed alley area, and to dedicate a portion of Lot 1112 for public street purposes. 17

BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 19 
act may be cited as the “	Howard East Towers Alley Closing and Street Dedication Emergency 20 
Act of 2023”. 21 
Sec. 2 (a) Pursuant to section 404 of the District of Columbia Home Rule Act, approved 22 
December 24, 1973 (87 Stat. 813; D.C. Official Code § 1-	204.04), and consistent with the Street 23 
and Alley Closing and Acquisition Procedures Act of 1982, effective March 10, 1983 (D.C. Law 24 
4-201; D.C. Official Code § 9-	201.01 et seq. ) (“Act”), the Council finds that a portion of the 25 
public alley in Square 2873, as shown on the Surveyor’s plat in S.O. 22- 03181, is unnecessary 26 
for alley purposes and orders it closed, with title to the land to vest as shown on the Surveyor’s 27 
plat. 28 
(b) There is established a 25-	foot wide building restriction line, in the area of the closed 29 
alley, that extends continuously the building restriction line already existing along W Street 30 
N.W.  31   	2 
(c) Pursuant to s ections 302 and 401 of the Act (D.C. Official Code § 9- 203.02 and 9-32 
204.01) , and notwithstanding the requirements set forth in sections 303, 304, and 421 of the Ac	t 33 
(D.C. Official Code §§ 9-203.03, 9- 203.04, and 9- 204.21), the Council accepts the dedication of 34 
a portion of Lot 1112 in Square 2873 for public street purposes and designates t he dedicated land 35 
as 9th Street N.W., as shown on the Surveyor’s plat filed under S.O. 22-	03181.  36 
Sec. 3. The ordering of the alley closure, establishment of a 25-	foot-wide building 37 
restriction line, and acceptance of the dedication and designation in section 2 set forth are 38 
contingent upon the satisfaction conditions set forth in the official file for S.O. 22-	03181 prior to 39 
the recordation of the plat by the Surveyor.   40 
Sec. 4. Fiscal impact statement. 41 
The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact 42 
statement required by section 4a of the General Legislative Procedures Act of 1975, approved 43 
October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-	301.47a). 44 
 Sec. 5. Effective date.  45 
This act shall take effect following approval by the Mayor (or in the event of a veto by 46 
the Mayor, action by the Council to override the veto), and shall remain in effect for no longer 47 
than 90 days, as provided for emergency acts of the Council of the District of Columbia in 48 
section 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 49 
Stat. 788; D.C. Official Code § 1-	204.12(a)). 50
