16-To order, on an emergency basis, the closing of a portion of an alley in Square 2873 abutting
17-Lots 1106 and 1112 in Ward 1 to establish a 25-foot-wide building restriction line on the
18-closed alley area and to dedicate a portion of Lot 1112 for public street purposes.

20-BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
21-act may be cited as the “Howard East Towers Alley Closing and Street Dedication Emergency
22-Act of 2023”.

24-Sec. 2 (a) Pursuant to section 404 of the District of Columbia Home Rule Act, approved
25-December 24, 1973 (87 Stat. 813; D.C. Official Code § 1-204.04), and the Street and Alley
26-Closing and Acquisition Procedures Act of 1982, effective March 10, 1983 (D.C. Law 4-201;
27-D.C. Official Code § 9-201.01 et seq.) (“Act”), the Council finds that a portion of the public
28-alley in Square 2873, as shown on the Surveyor’s plat in S.O. 22-03181, is unnecessary for alley
29-purposes and orders it closed, with title to the land to vest as shown on the Surveyor’s plat.
30-(b) There is established a 25-foot-wide building restriction line, in the area of the closed
31-alley, that extends continuously the building restriction line already existing along W Street,
32-NW.
33-(c) Pursuant to sections 302 and 401 of the Act (D.C. Official Code §§ 9-203.02 and 9-
34-204.01), and notwithstanding the requirements set forth in sections 303, 304, and 421 of the Act
35-(D.C. Official Code §§ 9-203.03, 9-203.04, and 9-204.21), the Council accepts the dedication of
36-a portion of Lot 1112 in Square 2873 for public street purposes and designates the dedicated land
37-as 9th Street, NW, as shown on the Surveyor’s plat filed under S.O. 22-03181.

39-Sec. 3. The ordering of the alley closure, establishment of a 25-foot-wide building
40-restriction line, and acceptance of the dedication and designation set forth in section 2 are
41-contingent upon the satisfaction of the conditions set forth in the official file for S.O. 22-03181
42-prior to the recordation of the plat by the Surveyor.

44-Sec. 4. Fiscal impact statement.
45-The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact
46-statement required by section 4a of the General Legislative Procedures Act of 1975, approved

54- Sec. 5. Effective date.
55-This act shall take effect following approval by the Mayor (or in the event of a veto by
56-the Mayor, action by the Council to override the veto), and shall remain in effect for no longer
57-than 90 days, as provided for emergency acts of the Council of the District of Columbia in
58-section 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87
59-Stat. 788; D.C. Official Code § 1-204.12(a)).
