16-To amend, on a temporary basis, the Comprehensive Policing and Justice Reform Amendment
17-Act of 2022 to clarify when law enforcement officers have authority to engage in a
18-vehicular pursuit of a suspect motor vehicle.
19- BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
20-act may be cited as the “Law Enforcement Vehicular Pursuit Clarification Temporary
21-Amendment Act of 2023”.

23- Sec. 2. Section 128(a) of the Comprehensive Policing and Justice Reform Amendment
24-Act of 2022, effective April 21, 2023 (D.C. Law 24-345; D.C. Official Code § 5-365.02(a)), is
25-amended as follows:
26-(a) Paragraph (1)(B) is amended by striking the phrase “immediate threat” and inserting
27-the phrase “imminent threat” in its place.
28-(b) Paragraph (2) is amended as follows:
29-(1) Subparagraph (A) is amended by striking the phrase “fleeing suspect,” and
30-inserting the phrase “fleeing suspect or suspects,” in its place.
31-(2) Subparagraph (B) is amended to read as follows
32-“(B) Under the totality of the circumstances, not likely to cause death or
33-serious bodily injury to any person, other than to the fleeing suspect or suspects; and”.

35-Sec. 3. Fiscal impact statement.
36-The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact
37-statement required by section 4a of the General Legislative Procedures Act of 1975, approved
38-October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

40-Sec. 4. Effective date.
41-(a) This act shall take effect following approval by the Mayor (or in the event of veto by
42-the Mayor, action by the Council to override the veto), a 30-day period of congressional review
43-as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December
44-24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of
