67+2. Pursuant to section 451 of the District of Columbia Home Rule Act,
68+28 approved December 24, 1973 (87 Stat. 803; D.C. Official
69+Code§ 1-204.51), and
70+29 notwithstanding the requirements
71+of section 202 of the Procurement Practices Reform
72+30 Act
73+of 2010, effective April 8, 2011 (D.C. Law 18-371; D.C. Official Code§ 2-352.02),
74+31 the Council approves Modification Nos. 5, 6, 7, and 8 to Contract No. DCKA-2022-C-
75+32 0010 with Lyft Bikes and Scooters, LLC to provide bike stations and bike station
76+33 equipment for the District's Capital Bikeshare system, and authorizes payment in the not- 34 to-exceed amount of $7,420,464 for the goods and services received and to be received
77+35 under the modifications.

79+3. Fiscal impact statement.

136+1 The contractor shall provide bike stations and bike stations equipment for the District's Capital
137+Bikeshare Bike System. The vendor will provide equipment that meets technical specifications

139+the District Department of Transportation Bikeshare stations and equipment specifications. The
140+contractor will deliver bike stations and equipment only
141+as authorized by issued and approved the
142+District
143+Task Orders. The period of performance is from December 6, 2022 through December 5,
144+2023.
145+(D) The selection process, including the number of offerors, the evaluation criteria, and the
146+evaluation results, including price, technical or quality, and past performance components:
147+The Request for Proposals (RFP) was advertised using full and open cooperative procurement
148+competition for all Bikeshare
149+member jurisdictions. Bikeshare Program comprises of six
150+DC/VA/MD jurisdictions jointly called "Member Jurisdictions". All Bikeshare member
151+jurisdictions jointly evaluated responses for technical and price using evaluation criteria prescribed
152+in the RFP. The
153+RFP evaluation criteria were 1. Ability to meet Member Jurisdictions' Technical
154+and Functional Requirements;
155+2. Cost; 3. General Vendor Background and Experience; 4.
156+Innovation; and
157+5. References for Past Performance. The evaluation committee recommended Lyft
158+Bikes and Scooters, LLC. as apparent successful offeror for the contract.
159+On March 31, 2022, the
160+Council
161+of the District of Columbia approved the Bike station Equipment and Services with Lyft
162+Bikes and Scooters, LLC via legislative number CA24-0433.
163+The term of the contract included a
164+one-year base period and a one-year option period.
165+(E) A description of any bid protest related to the award of the contract, including whether the
166+protest was resolved through litigation, withdrawal
167+of the protest by the protestor, or
168+voluntary corrective action by the District. Include the identity
169+of the protestor, the grounds

177+Lyft Bikes and Scooters, LLC has performed and delivered similar equipment to multiple cities in
178+the United States including
179+New York City, NY; Jersey City, NJ; Minneapolis, MN; and Portland,
180+OR. In addition, the contractor has successfully provided the same or similar services for the
181+District and has satisfactory performance.
182+(G) The period of performance associated with the proposed change, including date as of which
183+the proposed change
184+is to be made effective:
185+On November 30, 2022, contract modification MOS extended the period of performance through
186+February 5, 2023.
187+2 On February 3, 2023, contract modification M06 extended the partial option period of performance
188+from February 6, 2023 through April 7, 2023.

217+Contract DCKA-2022-C-0010 was awarded to Lyft Bikes and Scooters LLC. The contract included
218+an option to extend the services through
219+December 5, 2023. However, there was a delay in getting
220+compliance documents together for Council approval due to scheduling conflicts. As a result, the
221+District partially exercised option year one with a period
222+of performance from December 6, 2022
223+through February 5, 2023.
224+Due to further delays getting compliance documents prepared for
225+submission to Council the contract was further extended from February 6, 2023 through April 7,
226+2023, and again from April 8 through July 7, 2023
227+(M) The legal, regulatory, or contractual authority for the proposed change:
228+3 The proposed option exercise is authorized as a unilateral modification consistent with 27 DCMR
229+36 Section 3601.3(c).
230+(N) A summary of the subcontracting plan required under section 2346 of the Small, Local, and
231+Disadvantaged Business Enterprise Development and Assistance Act of 2005, as amended,

26-with Lyft Bikes and Scooters, LLC Approval and Payment Authorization Emergency Act of
27-2023”.

29-Sec. 2. Pursuant to section 451 of the District of Columbia Home Rule Act, approved
30-December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51), and notwithstanding the
31-requirements of section 202 of the Procurement Practices Reform Act of 2010, effective April 8,
32-2011 (D.C. Law 18-371; D.C. Official Code § 2-352.02), the Council approves Modification
33-Nos. 5, 6, 7, and 8 to Contract No. DCKA-2022-C-0010 with Lyft Bikes and Scooters, LLC to
34-provide bike stations and bike station equipment for the District’s Capital Bikeshare system and
35-authorizes payment in the not-to-exceed amount of $7,420,464 for the goods and services
36-received and to be received under the modifications.
