18-To amend, on an emergency basis, due to congressional review, the Comprehensive Policing and
19-Justice Reform Amendment Act of 2022 to clarify when law enforcement officers have
20-authority to engage in a vehicular pursuit of a suspect motor vehicle.

22- BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
23-act may be cited as the “Law Enforcement Vehicular Pursuit Clarification Congressional Review
24-Emergency Amendment Act of 2023”.

26-Sec. 2. Section 128(a) of the Comprehensive Policing and Justice Reform Amendment
27-Act of 2022, effective April 21, 2023 (D.C. Law 24-345; D.C. Official Code § 5-365.02(a)), is
28-amended as follows:
29-(a) Paragraph (1)(B) is amended by striking the phrase “immediate threat” and inserting
30-the phrase “imminent threat” in its place.
31-(b) Paragraph (2) is amended as follows:
32-(1) Subparagraph (A) is amended by striking the phrase “fleeing suspect,” and
33-inserting the phrase “fleeing suspect or suspects,” in its place.
34-(2) Subparagraph (B) is amended to read as follows
35-“(B) Under the totality of the circumstances, not likely to cause death or
36-serious bodily injury to any person, other than to the fleeing suspect or suspects; and”.

38-Sec. Applicability.
39-This act shall apply as of July 20,2023.

41-Sec. 4. Fiscal impact statement.
42-The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact
43-statement required by section 4a of the General Legislative Procedures Act of 1975, approved
44-October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

55-This act shall take effect following approval by the Mayor (or in the event of veto by the
56-Mayor, action by the Council to override the veto), and shall remain in effect for no longer than
57-90 days, as provided for emergency acts of the Council of the District of Columbia in section
58-412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788;
59-D.C. Official Code § 1-204.12(a)).
