16-To amend, on an emergency basis, due to congressional review, the Freedom of Information Act
17-of 1976 to exempt from disclosure critical infrastructure information or plans that contain
18-critical infrastructure information for the critical infrastructures of the District of Columbia
19-Water and Sewer Authority.

21- BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
22-act may be cited as the “DC Water Critical Infrastructure Freedom of Information Clarification
23-Congressional Review Emergency Amendment Act of 2023”.

25-Sec. 2. Section 204(a)(15) of the Freedom of Information Act of 1976, effective March 29,
26-1977 (D.C. Law 1-96; D.C. Official Code § 2-534(a)(15)), is amended by striking the phrase
27-“critical infrastructures of companies that are regulated by the Public Service Commission of the
28-District of Columbia” and inserting the phrase “critical infrastructures of the District of Columbia
29-Water and Sewer Authority or companies that are regulated by the Public Service Commission of
30-the District of Columbia” in its place.

32- Sec. 3. Applicability.
33- This act shall apply as of July 26, 2023.

35- Sec. 4. Fiscal impact statement.
36- The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact
37-statement required by section 4a of the General Legislative Procedures Act of 1975, approved
38-October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

40- Sec. 5. Effective date.
41- This act shall take effect following approval by the Mayor (or in the event of veto by the
42-Mayor, action by the Council to override the veto), and shall remain in effect for no longer than
43-90 days, as provided for emergency acts of the Council of the District of Columbia in section
