Gray 6 7 8 9 10 11 A BILL 12 ________ 13 14 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 15 _________________________ 16 17 To amend the District of Columbia Traffic Adjudication Act of 1978 to prevent the doubling of 18 certain motor vehicle tickets after 30 or 60 days has passed, and to permit the assessment 19 of fines and penalties of up to $15.” 20 21 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 22 act may be cited as the “Fair Motor Vehicle Fines and Penalties Amendment Act of 2024”. 23 Sec. 2. The District of Columbia Traffic Adjudication Act of 1978, approved 24 September 12, 1978 (D.C. Law D. 2-104; D.C. Official Code §§50-2301.01 et seq.), is 25 amended as follows: 26 (a) Section 105(a)(2) (D.C. Official Code § 50-2301.01(a)(2)) is amended as follows: 27 (1) Subparagraph (A) is amended by striking the phrase “a penalty equal to the 28 amount of the civil fine;” and replace it with the phrase “$10;” 29 (2) Subsection (B) is amended striking the phrase “a penalty equal to twice the 30 amount of the civil fine, and with respect to infractions under title III of this act, a penalty 31 equal to the amount of the civil fine plus $5.” and replace it with “a penalty that is no more 32 than $10, and with respect to infractions under title III of this act, a penalty no more than 33 $15”. 34 2 (b) Section 205(d) (D.C. Official Code § 50-2302.05(d))is amended by striking the 35 phrase “equal to the amount of the fine”. 36 Sec. 3. Fiscal impact statement. 37 The Council adopts the fiscal impact statement in the committee report as the fiscal 38 impact statement required by section 4a of the General Legislative Procedures Act of 1975, 39 approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 40 Sec. 4. Effective date. 41 This act shall take effect following approval by the Mayor (or in the event of veto by the 42 Mayor, action by the Council to override the veto), a 30-day period of congressional review as 43 provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 44 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of 45 Columbia Register. 46 47 48
