1717 To amend, on a temporary basis, the Legalization of Marijuana for Medical Treatment Initiative 14
1818 of 1999 to prohibit medical cannabis retailer licensees from locating within 300 feet of 15
1919 preschools, primary and secondary schools, and recreation centers without exception, and 16
2020 to authorize medical cannabis retailer license applicants whose locations are within 300 17
2121 feet of preschools, primary and secondary schools, and recreation centers to change the 18
2222 location of the retailer facility on its application within 180 calendar days after the 19
2323 effective date of this act. 20

2525 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 22
2626 act may be cited as the “Prohibition of Cannabis Retailers Near Schools Temporary Amendment 23
2727 Act of 2024”. 24
2828 Sec. 2. Section 7a of the Legalization of Marijuana for Medical Treatment Initiative of 25
2929 1999, effective February 25, 2010 (D.C. Law 13-315; D.C. Official Code § 7-1671.06a), is 26
3030 amended as follows: 27
3131 (a) Subsection (a) is amended by adding a new paragraph (3A) to read as follows: 28
3232 “(3A) An unlicensed establishment that actually applied for a retailer license 29
3333 under paragraph (3) of this subsection shall be allowed to change the location of the retailer 30
3434 facility on its application within 180 calendar days after the effective date of the Prohibition of 31
3535 Cannabis Retailers Near Schools Emergency Amendment Act of 2024, passed on emergency 32

3838 basis on April 2, 2024 (Enrolled version of Bill 25-XXX), without negatively affecting the status 33
3939 of the application, provided that: 34
4040 “(A) The location of the establishment in the original application filed 35
4141 with ABCA was within 300 feet of a preschool, primary or secondary school, or recreation 36
4242 center; and 37
4343 “(B) The main entrance to the preschool, primary or secondary school, or 38
4444 recreation center, or the nearest property line of the school or recreation center, is actually on or 39
4545 occupies ground zoned commercial or industrial according to the official atlases of the Zoning 40
4646 Commission of the District of Columbia.”. 41
4747 (b) Subsection (c) is amended by striking the phrase “shall not apply where” and inserting 42
4848 the phrase “shall not apply to cultivation center or internet retailer license applications where” in 43
4949 its place. 44
5050 Sec. 3. Fiscal impact statement. 45
5151 The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact 46
5252 statement required by section 4a of the General Legislative Procedures Act of 1975, approved 47
5353 October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 48
5454 Sec. 4. Effective date. 49
5555 (a) This act shall take effect following approval by the Mayor (or in the event of veto by 50
5656 the Mayor, action by the Council to override the veto), a 30-day period of congressional review 51
5757 as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December 52
5858 24, 1973 (87 Stat. 813; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of 53
5959 Columbia Register. 54

6262 (b) This act shall expire after 225 days of its having taken effect. 55
