19-To amend, on an emergency basis, the Freedom of Information Act of 1976 to exempt from
20-disclosure critical infrastructure information or plans that contain critical infrastructure
21-information for the critical infrastructures of the District of Columbia Water and Sewer
22-Authority.
23-BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
24-act may be cited as the “DC Water Critical Infrastructure Freedom of Information Clarification
25-Emergency Amendment Act of 2024”.

27-Sec. 2. Section 204(a)(15) of the Freedom of Information Act of 1976, effective March
28-29, 1977 (D.C. Law 1-96; D.C. Official Code § 2-534(a)(15)), is amended by striking the phrase
29-“critical infrastructures of companies that are regulated by the Public Service Commission of the
30-District of Columbia” and inserting the phrase “critical infrastructures of the District of
31-Columbia Water and Sewer Authority or companies that are regulated by the Public Service
32-Commission of the District of Columbia” in its place.

34-Sec. 3. Fiscal impact statement.
35-The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact
36-statement required by section 4a of the General Legislative Procedures Act of 1975, approved
37-October 16, 2006 (120 Stat. 2038; D.C. Official Code § l-301.47a).

39-Sec. 4. Effective date.
40-This act shall take effect following approval by the Mayor (or in the event of veto by the
41-Mayor, action by the Council to override the veto), and shall remain in effect for no longer than
42-90 days, as provided for emergency acts of the Council of the District of Columbia in section
