1717 To amend, on an emergency basis, the District of Columbia Theft and White Collar Crimes 14
1818 Act of 1982 to enhance penalties imposed for certain crimes against election officials. 15

2020 BE IT ENACTED BY THE COUNCIL DISTRICT OF COLUMBIA, That this act may 17
2121 be cited as the “Election Worker Protection Second Emergency Amendment Act of 2024”. 18
2222 Sec. 2. Title II of the District of Columbia Theft and White Collar Crimes Act of 1982 19
2323 effective December 1, 1982 (D.C. Law 4-164; D.C. Official Code § 22-3601 et seq.), is amended 20
2424 by adding a new section 204 as follows: 21
2525 “Sec. 204. Enhanced penalty for committing certain dangerous and violent crimes against 22
2626 election workers and officials. 23
2727 “(a) A person who commits any offense listed in subsection (b) of this section against an 24
2828 individual whom the person knew or believed to be a Board of Elections member, employee or 25
2929 volunteer while the member, employee or volunteer is engaged in the performance of his or her 26
3030 duties or on account of the performance of those duties, may be punished by a fine of up to one 27
3131 and 1/2 times the maximum fine otherwise authorized for the offense and may be imprisoned for 28 2

3434 a term of up to one and 1/2 times the maximum term of imprisonment otherwise authorized for 29
3535 the offense, or both. 30
3636 “(b) The provisions of subsection (a) of this section shall apply to the following offenses: 31
3737 Abduction, arson, aggravated assault, assault with a dangerous weapon, assault with intent to kill, 32
3838 assault with intent to commit any other offense, threats of violence, intimidation, harassment, 33
3939 stalking, burglary, carjacking, armed carjacking, extortion or blackmail accompanied by threats 34
4040 of violence, kidnapping, malicious disfigurement, manslaughter, mayhem, murder, robbery, 35
4141 sexual abuse in the first, second, and third degrees, theft, fraud in the first degree, fraud in the 36
4242 second degree, identity theft, or an attempt or conspiracy to commit any of the foregoing 37
4343 offenses.”. 38
4444 Sec. 3. Fiscal impact statement. 39
4545 The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact 40
4646 statement required by section 4a of the General Legislative Procedures Act of 1975, approved 41
4747 October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 42
4848 Sec. 4. Effective date. 43
4949 This act shall take effect following approval by the Mayor (or in the event of veto by the 44
5050 Mayor, action by the Council to override the veto), and shall remain in effect for no longer than 45
5151 90 days, as provided for emergency acts of the Council of the District of Columbia in section 46
5252 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 Stat. 788; 47
5353 D.C. Official Code § 1-204.12(a)). 48
