ENROLLED ORIGINAL A RESOLUTION 25-9 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA January 17, 2023 To declare the existence of an emergency, due to congressional review, with respect to the need to amend the Advisory Neighborhood Commissions Act of 1975 to extend pandemic provisions related to Advisory Neighborhood Commissions, including revised election procedures to fill vacancies on Advisory Neighborhood Commissions and authorization for Advisory Neighborhood Commissions to meet remotely. RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this resolution may be cited as the “ Advisory Neighborhood Commissions Pandemic Provisions Extension Congressional Review Emergency Declaration Resolution of 2023” . Sec. 2. (a) Since the onset of the pandemic, the Council has amended existing law to provide Advisory Neighborhood Commissions with the necessary flexibility and authority to continue their important work. (b) Among other things, t hese amendments established revised procedures to fill vacancies on Advisory Neighborhood commissions and permitted Advisory Neighborhood Commissions to meet and vote remotely . (c) The experience of Advisory Neighborhood Commissions during the pandemic demonstrated that the procedures established by this emergency and temporary legislation have improved both the efficiency and efficacy of Commissions and should continue. (d) Most recently, the Council passed the Advisory Neighborhood Commissions Pandemic Provisions Extension Second Emergency Amendment Act of 2022, which expires on February 19, 2023. The accompanying temporary legislation is still awaiting congressional review. Therefore, a congressional review emergency is necessary to avoid any gap in applicability. Sec. 3. The Council of the District of Columbia determines that the circumstances enumerated in section 2 constitute emergency circumstances making it necessary that the Advisory Neighborhood Commissions Pandemic Provisions Extension Congressional Review Emergency Amendment Act of 2023 be adopted after a single reading. Sec. 4. This resolution shall take effect immediately.
