27+To declare the existence of an emergency with respect to the need to amend the Migrant Services 18
28+and Supports Temporary Act to clarify eligibility requirements and supports provided by 19
29+the Office of Migrant Services and for immigrant residents accessing homeless services. 20

31+RESOLVED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
32+ 22
33+resolution may be cited as the “ Migrant Services Eligibility Clarification Emergency Declaration 23
34+Resolution of 2023”. 24
35+Sec. 2. (a) There exists an immediate need to clarify services the Mayor is authorized to 25
36+provide under the Migrant Services and Supports Temporary Act of 2022, passed on 2nd reading 26
37+on October 4, 2022 (Enrolled version of Bill 24- 0991). 27
38+(b) The Office of Migrant Serv ices has been established under prior legislation and has 28
39+begun providing an array of services to migrants entering the District. 29
40+(c) The experience of providing those services, however, has demonstrated the need to 30
41+clarify the scope of services provided and the eligibility and termination criteria for those 31
42+services and supports, and to provide adequate notice to individuals of the denial or termination 32

17-and Supports Temporary Act of 2022 to clarify eligibility requirements and supports
18-provided by the Office of Migrant Services; and to amend the Homeless Services Reform
19-Act of 2005 to clarify eligibility requirements for immigrant residents accessing homeless
20-services.

22-RESOLVED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
23-resolution may be cited as the “Migrant Services Eligibility Clarification Emergency Declaration
24-Resolution of 2023”.

26-Sec. 2. (a) There exists an immediate need to clarify the services that the Mayor is
27-authorized to provide under the Migrant Services and Supports Temporary Act of 2022,effective
28-December 21, 2022 (D.C. Law 24-234; D.C. Official Code § 4-773.01 et seq.).
29-(b) The Office of Migrant Services was established under prior legislation, and it has
30-begun providing an array of services to migrants entering the District.
31-(c) The experience of providing those services, however, has demonstrated the need to
32-clarify the scope of services to be provided and the eligibility and termination criteria for those
33-services and supports, and to provide adequate notice to individuals of the denial or termination
34-of services.
35-(d) In addition, clarity is required to ensure that persons seeking shelter are not denied
36-access to shelter in both the migrant services and homeless services systems.
37-(e) The emergency measure is also necessary to rectify a drafting error in the original bill,
38-which unintentionally has expansive impacts on the ability of some individuals to receive
39-services to which they would otherwise be entitled.

41-Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
42-emergency circumstances making it necessary that the Migrant Services Eligibility Clarification
43-Emergency Amendment Act of 2023 should be adopted after a single reading.

45+(d) In addition, clarity is required to ensure that persons seeking shelter are not denied 34

47+(e) Finally, this emergency measure is also necessary to rectify a drafting error in the 36
48+original bill which has unintentionally expansive impacts on the ability of some individuals to 37

50+Sec. 3. The Council of the District of Columbia determines that the circumstances 39
51+enumerated in section 2 constitute emergency circumstances making it necessary that the 40
52+Migrant Services Eligibility Clarification Emergency Amendment Act of 2023 should be 41
53+adopted after a single reading.
