26+RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That
27+24this resolution may be cited as the “Modifications to Contract No. CW90941 with
28+25Aramark Correctional Services, LLC Approval and Payment Authorization Emergency
29+26Declaration Resolution of 2023”.
30+27 Sec. 2. (a) There exists a need to approve Modification Nos. 8, 9, 10, 11, 12, and
31+28 13 to Contract No. CW90941 with Aramark Correctional Services, LLC to provide
32+management and operation of the food service program for inmates, and to authorize29
33+payment for the goods and services received and to be received under the modifications.30
34+(b) By Modification No. 8, dated September 14, 2022, the Office of Contracting31
35+and Procurement, on behalf of the Department of Corrections, exercised a partial option32
36+33period 1 of Contract No. CW90941 for the period from September 15, 2022 through

16-To declare the existence of an emergency with respect to the need to approve Modification Nos.

22-RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
23-resolution may be cited as the “Modifications to Contract No. CW90941 with Aramark
24-Correctional Services, LLC Approval and Payment Authorization Emergency Declaration
25-Resolution of 2023”.

27-Sec. 2. (a) There exists an immediate need to approve Modification Nos. 8, 9, 10, 11, 12,
28-and 13 to Contract No. CW90941 with Aramark Correctional Services, LLC to provide
29-management and operation of the food service program for inmates and to authorize payment for
30-the goods and services received and to be received under the modifications.
31-(b) By Modification No. 8, dated September 14, 2022, the Office of Contracting and
32-Procurement, on behalf of the Department of Corrections, exercised a partial Option Period One
33-of Contract No. CW90941 for the period from September 15, 2022 through November 30, 2022,
34-in the not-to-exceed amount of $1 million.
35-(c) By Modification No. 9, dated October 14, 2022, the Office of Contracting and
36-Procurement, on behalf of the Department of Corrections, extended the term of the partial Option
37-Period One of Contract No. CW90941 from December 1, 2022 to December 31, 2022, at no cost
38-to the District.
39-(d) By Modification No. 10, dated December 19, 2022, the Office of Contracting and
40-Procurement, on behalf of the Department of Corrections, exercised another partial Option
41-Period One of Contract No. CW90941 for the period from January 1, 2023 through February 28,
42-2023, in the not-to-exceed amount of $1,426,000.
43-(e) By Modification No. 11, dated February 15, 2023, the Office of Contracting and
44-Procurement, on behalf of the Department of Corrections, extended the term of the partial Option
45-Period One of Contract No. CW90941 from March 1, 2023 to March 15, 2023, at no cost to the

52-(f) By Modification No. 12, dated, March 9, 2023, the Office of Contracting and
53-Procurement, on behalf of the Department of Corrections, exercised another partial Option
54-Period One of Contract No. CW90941 for the period from March 16, 2023 through April 15,
55-2023, in the not-to-exceed amount of $1.2 million.
56-(g) Modification No. 13 is now necessary to exercise the remainder of Option Period
57-One of Contract No. CW90941 for the period from April 16, 2023, through September 14, 2023,
58-in the not-to-exceed amount of $2,413,889, raising the total not-to-exceed amount for the period
59-from September 15, 2022, through September 14, 2023, to $6,039,889.
60-(h) Council approval is required by section 451(b) of the District of Columbia Home
61-Rule Act, approved December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)), as
62-these modifications increase the contract to more than $1 million during a 12-month period.
63- (i) Approval is necessary to allow the continuation of these vital services. Without this
64-approval, Aramark Correctional Services, LLC cannot be paid for goods and services provided in
65-excess of $1 million for the contract period September 15, 2022 through September 14, 2023.

67-Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
68-emergency circumstances making it necessary that the Modifications to Contract No. CW90941
69-with Aramark Correctional Services, LLC Approval and Payment Authorization Emergency Act
70-of 2023 be adopted after a single reading.

72-Sec. 4. This resolution shall take effect immediately.

84+(g) Modification No. 13 is now necessary to exercise the remainder of option51
85+period 1 of Contract No. CW90941 for the period from April 16, 2023 through52
86+September 14, 2023 in the not-to-exceed amount of $2,413,889, raising the total not-to-53
87+exceed amount for the period from September 15, 2022 through September 14, 2023 to54
