	12	+	the United States Environmental Protection Agency Clean School Bus Rebate Program.

	20	+	1-204.51) and section 202 of the Procurement Practices Reform Act of 2010 (D.C. Official Code
	21	+	§ 2-352.02), enclosed for consideration and enactment by the Council of the District of Columbia
	22	+	is the Multi-year "'Contract No. CW104923 with Phoenix Electric Sales, Inc. Emergency
	23	+	Approval Resolution of 2023,” and accompanying emergency declaration.

	26	+	RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
	27	+	resolution may be cited as the “Contract No. CW104923 with Phoenix Electric Sales, Inc.22
	28	+	Emergency Declaration Resolution of 2023”.23
	29	+	Sec. 2. (a) The Office of Contracting and Procurement, on behalf of the Office of the24
	30	+	State Superintendent of Education, proposes to enter into multiyear Contract No. CW10492325
	31	+	with Phoenix Electric Sales, Inc. to provide 10 electric school buses as part of the Environmental26
	32	+	Protection Agency’s 2022 Clean School Bus Rebate Program.27
	33	+	(b) The not-to-exceed price for the term of this multiyear contract with Phoenix28
	34	+	Electric Sales, Inc. is S3,681,490 for the two-year period of performance.29
	35	+	(c) Approval is necessary to allow the District to receive the benefit of this vital30
	36	+	service in a timely manner from Phoenix Electric Sales, Inc.31
	37	+	(d) These critical services can only be obtained through an award of the32

22		-	resolution may be cited as the “Contract No. CW104923 with Phoenix Electric Sales, Inc.

25		-	Sec. 2. (a) The Office of Contracting and Procurement, on behalf of the Office of the
