26+RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
27+resolution may be cited as the “Contract No. CW104923 with Phoenix Electric Sales, Inc.20
28+Emergency Approval Resolution of 2023.”21
29+Sec. 2. (a) The Office of Contracting and Procurement, on behalf of the Office of the22
30+State Superintendent of Education, proposes to enter into a multiyear contract with Phoenix23
31+24
32+Agency’s 2022 Clean School Bus Rebate Program.25
33+(b) The not-to-exceed price for the term of this multiyear contract with Phoenix
34+26
35+Electric Sales, Inc. is $3,681,490. The term will be two years from the date of award.27
36+Sec. 3. Pursuant to section 451(c)(3) of the District of Columbia Home Rule Act,28
37+approved December 24, 1973 (87 Stat. 803; Pub. L. 93-198; D.C. Official Code § 129
38+204.51(c)(3)), and section 202 of the Procurement Practices Reform Act of 2010, effective April30

25- Sec. 2. Pursuant to section 451(c)(3) of the District of Columbia Home Rule Act,
26-approved December 24, 1973 (87 Stat. 803; Pub. L. 93-198; D.C. Official Code § 1-
27-204.51(c)(3)), and section 202 of the Procurement Practices Reform Act of 2010, effective April
28-8, 2011 (D.C. Law 18-371; D.C. Official Code § 2-352.02), the Council approves multiyear
29-Contract No. CW104923 with Phoenix Electric Sales, Inc. to provide 10 electric school buses to
30-the Office of the State Superintendent of Education as part of the Environmental Protection
31-Agency’s 2022 Clean School Bus Rebate Program in the not-to-exceed amount of $3,681,490 for
32-the 2-year term of the contract.

34- Sec. 3. The Council adopts the fiscal impact statement of the Chief Financial Officer as
35-the fiscal impact statement required by section 4a of the General Legislative Procedures Act of
36-1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

38-Sec. 4. The Secretary to the Council shall transmit a copy of this resolution, upon its
39-adoption, to the Mayor.
