13+emergency bill, the “Contract No. GAGA-202 l-C-0157 with Hi-Tech Solutions, Inc. Approval

27+That this act may be cited as the “Contract No. GAGA-202l-C-0157 with Hi-Tech23
28+24Solution, Inc. Approval and Payment Authorization Emergency Act of 2023”.
29+25 Sec. 2. Pursuant to section 451 of the District of Columbia Home Rule Act,
30+approved December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51), and26
31+notwithstanding the requirements of section 202 of the Procurement Practices Reform27
32+Act of 2010, effective April 8, 2011 (D.C. Law 18-371; D.C. Official Code § 2-352.02),28
33+the Council approves Contract No. GAGA-2021 -C-0157 with Hi-Tech Solution, Inc., and29
34+Modification Nos. 1, 2, 3, 4, 5, and 7 thereto, to provide smartboards and related services30
35+to the District of Columbia Public Schools, and authorizes payment in the not-to-exceed31

16-To declare the existence of an emergency with respect to the need to approve Contract No.
17-GAGA-2021-C-0157 with Hi-Tech Solution, Inc., and Modification Nos. 1, 2, 3, 4, 5,
18-and 7 thereto, to provide smartboards and related services to District of Columbia Public
19-Schools, and to authorize payment for the goods and services received and to be received

22-RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
23-resolution may be cited as the “Contract No. GAGA-2021-C-0157 with Hi-Tech Solution, Inc.
24-Approval and Payment Authorization Emergency Declaration Resolution of 2023”.

26-Sec. 2. (a) There exists an immediate need to approve Contract No. GAGA-2021-C-0157
27-with Hi-Tech Solution, Inc., and Modification Nos. 1, 2, 3, 5, and 7 thereto, to provide
28-smartboards and related services to the District of Columbia Public Schools (“DCPS”), and to
29-authorize payment for the goods and services received and to be received under the contract and
30-the modifications.
31-(b) On October 14, 2021, DCPS awarded Contract No. GAGA-2021-C-0157 to Hi-Tech
32-Solution, Inc., for the base period October 14, 2021 through September 1, 2022 in the not-to-
33-exceed amount of $2,587,290.
34-(c) By Modification No. 1, dated July 27, 2022, DCPS increased the not-to-exceed
35-amount of the base period to $8,121,654.56 and retroactively adjusted the base period of
36-performance to October 1, 2021 through September 30, 2022.
37-(d) By Modification No. 2, dated October 13, 2022, DCPS exercised a part of Option
38-Year One of Contract No. GAGA-2020-C-0157 for the period from October 14, 2022 through
39-November 30, 2022 in the not-to-exceed amount of $999,660. There is no indication that
40-services ceased between September 30, 2022 and October 14, 2022 or that the parties intended
41-services to cease.
42-(e) By Modification No. 3, dated November 30, 2022, DCPS exercised another part of
43-option year one of Contract No. GAGA-2020-C-0157 for the period from November 30, 2022
44-through February 28, 2023, at no cost to the District. ENROLLED ORIGINAL

50-(f) By Modification No. 4, dated February 28, 2023, DCPS exercised another part of
51-Option Year One of Contract No. GAGA-2020-C-0157 for the period from March 1, 2023
52-through April 15, 2023, at no cost to the District.
53-(g) By Modification No. 5, dated April 15, 2023, DCPS exercised another part of Option
54-Year One of Contract No. GAGA-2020-C-0157 for the period from April 16, 2023 through May
55-31, 2023, at no cost to the District and retroactively adjusted the Option Year One period of
56-performance to October 1, 2022 through September 30, 2022.
57-(h) By Modification No. 7, dated May 31, 2023, DCPS exercised the remainder of Option
58-Year One of Contract No. GAGA-2020-C-0016 for the period from June 1, 2023 through
59-September 30, 2023 in the not-to-exceed amount of $6,800,941.
60-(i) Council approval is required by section 451(b) of the District of Columbia Home Rule
61-Act, approved December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)), because the
62-base period and option year One are each in excess of $1 million during separate 12-month
63-periods.
64- (j) Approval is necessary to allow the continuation of these vital services. Without this
65-approval, Hi-Tech Solution, Inc. cannot be paid for goods and services provided in excess of $1
66-million for the base period of the contract, from October 1, 2021 through September 30, 2022 or
67-for Option Year One period of the contract, from October 1, 2022 through September 30, 2023.

69-Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
70-emergency circumstances making it necessary that the Contract No. GAGA-2021-C-0157 with
71-Hi-Tech Solution, Inc. Approval and Payment Authorization Emergency Act of 2023 be adopted
72-after a single reading.

124+information technology company headquartered in Washington, DC. HTSI is a small business
125+provider of information technology infrastructure solutions and information technology
126+management services to federal, state, and local government agencies and educational institutions.
127+HTSI is a certified business enterprise (CBE) and has an awarded DC Supply Schedule contract for
128+information technology, software, and audio-visual.
129+On August 11, 2021, the District of Columbia Public Schools (DCPS), Office of Contracts and
130+Acquisitions, issued Invitation for Bids (IFB) No. GAGA-2021-1-0157 in the open market, with a
131+35% certified business enterprise subcontracting requirement. Three bidders responded by the
132+closing date of August 20, 2021. The contracting officer awarded the contract on August 24, 2021
133+to Hi-Tech Solution, Inc., as the lowest-priced responsive and responsible bidder.
134+The contractor will provide critical services and support to ensure continuity of operations,
135+continued pandemic recovery, and ongoing learning for DCPS students.
136+(H) The value of any work or services performed pursuant to a proposed change for which the

151+Hi-Tech Solution is a certified business enterprise in the District of Columbia; therefore, no
152+subcontracting plan is required.
153+The contracting officer awarded the initial contract and continued with the exercise of option year
154+one so that DCPS could provide critical services and goods to support DCPS classrooms. The
155+contractor provides smartboards and installation services that allows DCPS to offer students
156+technology access which supports identified educational goals and objectives.
157+There were multiple factors resulting in the awarding of the contract actions prior to submission to
158+the Council. The main factor was that DCPS experienced increased rates of vacancies and
159+turnovers in key staff, including the chief contracting officer position. This factor, along with the
160+decentralized administrative structure of DCPS's contracting function, resulted in a failure to
161+request and obtain Council approval before the contract actions were implemented. DCPS regrets
162+this failure and is working to update and improve its processes and procedures and determine
163+appropriate administrative actions to be taken in response to the failure.

313+Modification No. 1 to the Contract, signed by the Contracting Officer on July 7, 2022, changed
314+the starting date of the Contract from October 14, 2021, to October 1, 2021. That retroactive
315+change is improper and inconsistent with basic contracting principles. Modification No. 2
