15-To declare an emergency with respect to the need to amend the Condominium Act of 1976 to
16-authorize condominium unit owners’ associations to conduct virtual meetings and to
17-clarify voting and quorum requirements for such meetings; and to amend section 29-910
18-of the District of Columbia Official Code to allow cooperatives to conduct remote
19-meetings.

21-RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
22-resolution may be cited as the “Association Meeting Flexibility Emergency Declaration
23-Resolution of 2023”.

25-Sec. 2. (a) In response to the COVID-19 pandemic, the Council granted flexibility to
26-condominium and cooperative associations to conduct meetings by virtual means.
27-(b) While many COVID-19-related changes have been allowed to lapse, virtual meetings
28-have become routine for many District residents and continue to provide a benefit to
29-condominium and cooperative association leaders and occupants.
30-(c) The most recent extension of such flexibilities to condominium and cooperative
31-associations, the Post-Public Health Emergency Protections Extension Temporary Amendment
32-Act of 2022, effective December 21, 2022 (D.C. Law 24-226; 70 DCR 22), will expire on
33-August 3, 2023.
34-(d) Emergency legislation is necessary to ensure that associations can continue to meet by
35-virtual means without the need to amend their bylaws.

37-Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
38-an emergency making it necessary that the Association Meeting Flexibility Emergency
39-Amendment Act of 2023 be adopted after a single reading.

41-Sec. 4. This resolution shall take effect immediately.
