17-To declare the existence of an emergency with respect to the need to amend the Department of
18-For-Hire Vehicles Establishment Act of 1985 to authorize the Department of For-Hire
19-Vehicles to enforce traffic laws against carrier-for-hire vehicles.

21-RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
22-resolution may be cited as the “Department of For-Hire Vehicles Delivery Vehicle Traffic
23-Enforcement Expansion Emergency Declaration Resolution of 2023”.

25-Sec. 2. (a) On October 4, 2022, the Council passed the Department of For-Hire Vehicles
26-Delivery Vehicle Traffic Enforcement Expansion Temporary Act of 2022, effective December
27-21, 2022 (D.C. Law 24-227; 69 DCR 13987) (“temporary act”). The temporary act is set to
28-expire on August 3, 2023.
29-(b) The provisions of this emergency legislation are identical to the temporary act and
30-will prevent a gap in the law as the Council advances the permanent legislation.

32-Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
33-emergency circumstances making it necessary that the Department of For-Hire Vehicles
34-Delivery Vehicle Traffic Enforcement Expansion Emergency Amendment Act of 2023 be
35-adopted after a single reading.

37-Sec. 4. This resolution shall take effect immediately.
