14-To declare the existence of an emergency, due to congressional review, with respect to the need
15-to prohibit a third-party meal delivery service from excluding any restaurant with whom
16-the third-party meal delivery service has an agreement from a customer within 4 miles of
17-a restaurant, to restrict third-party meal delivery services from reducing a restaurant’s
18-delivery radius below 4 miles based on the level or percentage of commissions paid, to
19-restrict third-party meal delivery services from limiting driver availability based on the
20-level or percentage of commissions paid, to require third-party meal delivery services to
21-disclose, in plain language, all fees, commissions, and charges related to contracted
22-services for covered restaurants, and to make other clarifying changes.

24- RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
25-resolution may be cited as the “Food Delivery Fees Transparency Congressional Review
26-Emergency Declaration Resolution of 2023”.

28- Sec. 2. (a) On May 2, 2023, the Council passed the Food Delivery Fees Transparency
29-Emergency Amendment Act of 2023, effective May 24, 2023 (D.C. Act 25-108; 70 DCR 7927)
30-(“emergency act”). The emergency act will expire on August 22, 2023.
31- (b) On June 6, 2023, the Council passed the Food Delivery Fees Temporary Amendment
32-Act of 2023, enacted on June 29, 2023 (D.C. Act 25-153; 70 DCR 9412) (“temporary act”). The
33-temporary act is projected to become law on September 22, 2023.
34- (c) To prevent a gap in the law between the expiration of the emergency act and the
35-effective date of the temporary act, it is necessary to pass congressional review emergency
36-legislation.

38- Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
39-emergency circumstances making it necessary that the Food Delivery Fees Congressional
40-Review Emergency Amendment Act of 2023 be adopted after a single reading.

42- Sec. 4. This resolution shall take effect immediately.

20+from reducing a restaurant’s placement within a given list of restaurants on a third-party 18
21+food delivery platform based on the level or percentage of commissions paid, to restrict 19
22+third-party meal delivery services from reducing a restaurant’s delivery radius based on the 20
23+level or percentage of commissions paid, to restrict third-party meal delivery services from 21
24+limiting driver availability based on the level or percentage of commissions paid, to require 22
25+third-party meal delivery services to disclose, in plain language, all fees, commissions, and 23
26+charges related to contracted services for covered restaurants, and to make other clarifying 24
