13+by the Council of the District of Columbia is proposed
14+bill, the "Modification Nos.
15+15, 16, and 17 to Contract No. DCKA-2017-C-0047 with First Choice
16+Masonry, Inc. Approval and Payment Authorization Emergency
17+Act of2023," and the accompanying
18+emergency declaration resolution.
19+The legislation will approve Modification Nos.
20+15 and 16 and proposed Modification No. 17 to
21+fully exercise option year four
22+of Contract No. DCKA-2017-C-0047 with First Choice Masonry,
23+Inc. for construction and related services for the installation
24+of bicycle and pedestrian facilities. In
25+addition, the legislation will approve payment for services received and to be received under option
26+year four
27+of the contract.

16-To declare the existence of an emergency with respect to the need to approve Modification Nos.
17-15, 16, and 17 to Contract No. DCKA-2017-C-0047 with First Choice Masonry, Inc. to
18-provide construction and related services for the installation of bicycle and pedestrian
19-facilities to the Department of Transportation, and to authorize payment for the goods and
20-services received and to be received under the modifications.

22-RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
23-resolution may be cited as the “Modification Nos. 15, 16, and 17 to Contract No. DCKA-2017-
24-C-0047 with First Choice Masonry, Inc. Approval and Payment Authorization Emergency
25-Declaration Resolution of 2023”.

27-Sec. 2. (a) There exists an immediate need to approve Modification Nos. 15, 16, and 17
28-to Contract No. DCKA-2017-C-0047 with First Choice Masonry, Inc. to provide construction
29-and related services for the installation of bicycle and pedestrian facilities to the Department of
30-Transportation and authorize payment for the goods and services received and to be received
31-under the modifications.
32-(b) By Modification No. 15, dated February 21, 2023, the Office of Contracting and
33-Procurement, on behalf of the Department of Transportation, exercised a part of Option Year 4
34-of Contract No. DCKA-2017-C-0047 for the period February 27, 2023 through May 28, 2023, in
35-the not-to-exceed amount of $999,000.
36-(c) By Modification No. 16, dated May 15, 2023, the Office of Contracting and
37-Procurement, on behalf of the Department of Transportation, exercised another part of Option
38-Year 4 of Contract No. DCKA-2017-C-0047 for the period May 29, 2023 through August 25,
39-2023, at no cost to the District.
40-(d) Modification No. 17 is now necessary to exercise the remainder of Option Year 4 for
41-the period August 26, 2023 through February 26, 2024, in the not-to-exceed amount of
42-$964,602.55, thereby increasing the total not-to-exceed amount of Option Year 4 to
43-$1,963,602.55.
44-(e) Council approval is required by section 451(b) of the District of Columbia Home
45-Rule Act, approved December 24, 1973 (87 Stat. 803; D.C. Official Code § 1-204.51(b)), as the

129+55 Approval and Payment Authorization Emergency Act of 2023 be adopted after a single
130+56 reading.

132+4. This resolution shall take effect immediately.
