15-To amend the Homeless Services Reform Act of 2005 to establish grounds for an extension to
16-the Family Re-Housing Stabilization Program, whereby the Department of Human
17-Services or its designee will thoroughly consider the totality of the participant's
18-circumstances, including their progress and eligibility for affordable housing.

20-BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
21-act may be cited as the “Family Re-Housing Stabilization Program Protection Temporary
22-Amendment Act of 2023”.

24-Sec. 2. Section 7(b)(4)(B) of the Homeless Services Reform Act of 2005, effective
25-October 22, 2005 (D.C. Law 16-35; D.C. Official Code § 4–753.01(b)(4)(B)), is amended as
26-follows:
27-(a) The existing text is designated as sub-subparagraph (i).
28-(b) New sub-subparagraphs (ii) and (iii) are added to read as follows:
29-“(ii) The Department, or the Department’s designee, shall consider
30-requests for Family Re-Housing Stabilization Program (“FRSP”) assistance extending past 12
31-months if:
32-“(I) There is funding available within FRSP;
33-“(II) The participant has requested an extension in writing;
34-“(III) The participant has made a good faith effort towards
35-the achievement of goals set forth in an individualized plan with the aim of a targeted
36-progression towards exit from the supports of FRSP, as observed by the service provider at
37-consistent intervals, but cannot yet sustain housing stability independently of FRSP; and
38- “(IV) The participant has not yet been approved for
39-permanently affordable housing.
40- “(iii) When making a determination of whether to grant a
41-participant in FRSP an extension beyond 12 months, the Department or Department's designee
42-shall:
43-“(I) Consider the totality of the circumstances; and
44-“(II) Grant extensions of time in increments not greater
45-than 6 months, with regular formal reviews every 3 months to ensure that participants are given
46-the support necessary to exit FRSP with stable housing.” ENROLLED ORIGINAL

51- “(iv) If a requested extension of FRSP assistance by a participant is
52-denied, the participant shall be given 30 days written notice prior to the final subsidy payment
53-explicitly setting forth the reason for the denial of additional assistance and inform the
54-participant that the FRSP participant has a right to:
55-“(I) Appeal the determination through a fair hearing and
56-administrative review, including deadlines for requesting an appeal; and
57-“(II) The continuation of FRSP services pending the
58-outcome of any fair hearing requested within 15 days of receipt of written notice of a
59-termination.”.

61-Sec. 3. Applicability.
62-This act shall apply as of July 31, 2023.

64-Sec. 4. Fiscal impact statement.
65-The Council adopts the fiscal impact statement of the Budget Director as the fiscal impact
66-statement required by section 4a of the General Legislative Procedures Act of 1975, approved
67-October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-301.47a).

69-Sec. 5. Effective date.
70-(a) This act shall take effect following approval by the Mayor (or in the event of veto by
71-the Mayor, action by the Council to override the veto), a 30-day period of congressional review
72-as provided in section 602(c)(1) of the District of Columbia Home Rule Act, approved December
73-24, 1973 (87 Stat. 788; D.C. Official Code § 1-206.02(c)(1)), and publication in the District of
74-Columbia Register.
75-(b) This act shall expire after 225 days of its having taken effect.

17+To declare the existence of an emergency, due to congressional review with respect to the need 16
18+to continue authorization for Advisory Neighborhood Commissions to meet remotely. 17

20+ RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 19
21+resolution may be cited as the “ Advisory Neighborhood Commissions Remote Operations 20
22+ Congressional Review Emergency Declaration Resolution of 2023” . 21
23+ Sec. 2. (a) Since 2020, the Council has amended existing law to provide Advisory 22
24+Neighborhood Commissions with the necessary flexibility and authority to continue their 23
25+important work. 24
26+(b) Among other things, these amendments permitted Advisory Neighborhood 25
27+Commissions to meet and vote remotely . 26
28+ (c) These provisions were incorporated into the Coronavirus Support Temporary 27
29+Amendment Act of 2021. 28
30+ (d) Subsequently, the Council passed the Advisory Neighborhood Commissions 29
31+Pandemic Provisions Extension Temporary Amendment Act of 2022, which expire d on 30
32+November 19, 2022 and the Advisory Neighborhood Commissions Pandemic Provisions 31
33+Extension Second Temporary Amendment Act of 2022, which expired on October 6

36+ (e) Finally, the Council passed the Advisory Neighborhood Commissions Remote 1
37+Operations Emergency Operations Emergency Amendment Act of 2023, which is scheduled to 2
38+expire on October 24

40+, 2023, before the related temporary act is anticipated to complete 3
41+congressional review. 4
42+ (g) The experience of Advisory Neighborhood Commissions during the pandemic 5
43+demonstrated that the procedures established by this emergency and temporary legislation have 6
44+improved both the efficiency and efficacy of Commissions and should continue. 7
45+ (h) Congressional review emergency legislation is needed now out of an 8
46+abundance of caution to ensure no gap in coverage. 9
47+Sec. 3. The Council of the District of Columbia determines that the circumstances 10
48+enumerated in section 2 constitute emergency circumstances making it necessary that the 11
49+“Advisory Neighborhood Commissions Remote Operations Congressional Review Emergency 12
50+Amendment Act of 2023 ” be adopted after a single reading. 13
51+Sec. 4. This resolution shall take effect immediately. 14
