8484 A:
8585 This Agreement is entered into between the District of Columbia Government , Department of
8686 Behavioral Health (hereinafter referred to as the "Employer" or "DBH") and Public Service
8787 Employees Local 572, Laborers International Union
8888 of North America (LIUNA), affiliated with
8989 AFL-CIO (hereinafter referred
9090 to as the "Union"). The term "Employer" as used herein shall
9191 apply interchangeably to those officials or their authorized designees
9292 as the individual provisions
9393 of the Agreement may be applicable or as the authority is established by law.
9494 Section B:
9595 The Employer and the Union recognize the need to provide efficient service to the public and to
9696 maintain the quality
9797 of service. Further, both parties agree to the need for establishing and
9898 maintaining a sound labor-management relationship and mutually agree to continue working
9999 toward this goal. Each side has been afforded the opportunity to put forth all
100100 of its proposals and
101101 to bargain in good faith, and both parties agree that this Agreement expresses the results of their
102102 negotiations. Therefore,
103103 to ensure the stability of this Agreement, no new provisions shall be
104104 proposed during the term unless provided for elsewhere in the Agreement or such proposal
105105 is
106106 entertained by mutual agreement of the parties.
107107 Section C:
108108 The Union is the exclusive representative of all employees in the Motor Pool and Maintenance
109109 bargaining Units and,
110110 as such, is responsible for representing the interests of all such employees
111111 without discrimination and without regard
112112 to Union membership.
113113 Section A -Fiscal Year 2022:
114114 ARTICLE 1
115115 WAGES
116116 In lieu of a wage increase for FY 2022, employees will receive a three and one-half percent
117117 (3.5%) bonus payment. Bargaining unit employees actively on the payroll
118118 as of October 1, 2021,
119119 shall receive a one-time payment that
120120 is equivalent of 3.5% of an employee's annual base salary
121121 as of October 1, 2021.
122122 3 The payment will be made no later than ninety (90) days after the Council's approval of this
123123 agreement.
124124 Section B -Fiscal Year 2023:
125125 Effective the first day of the first full pay period beginning on or after October 1, 2023 wages for
126126 all bargaining unit members covered by this Agreement and who are actively employed
127127 as of
128128 October 1, 2022, shall be increased by two and one-half percent (2.5%).
129129 Section C -Fiscal Year 2024:
130130 Effective the first day of the first full pay period beginning on or after October 1, 2024, wages for all
131131 bargaining unit members covered by this Agreement and who are actively employed as
132132 of October 1,
133133 2023, shall be increased by three percent (3%).
134134 Section D -Fiscal Year 2025:
135135 Effective the first day of the first full pay period beginning on or after October 1, 2025, wages for all
136136 bargaining unit members covered by this Agreement and who are actively employed

138138 2024, shall be increased by three percent
139139 (3%).
140140 Section E -Differentials:
141141 Pay for shift differentials shall be paid in accordance with the District Personnel Manual and
142142 Comprehensive Merit Personnel Act (CMPA),
143143 as it reads at the signing of this Agreement,

145145 to any changes in the law. Neither party shall seek to change the law.
146146 ARTICLE 2
147147 HEALTH, OPTICAL AND DENTAL PLANS
148148 Bargaining unit members will continue to be covered by the health, optical and dental insurance
149149 programs applicable to District government employees
150150 as offered by the District government.

152152 CALL BACK /CALL-IN/TROUBLESHOOTING

154154 A:
155155 A minimum of four (4) hours of work shall be credited to any employee who is called back to
156156 perform unscheduled work either on a regular workday, Monday through midnight Friday, after
157157 he/she has completed the regular work schedule and has left his/her place
158158 of employment, or,
159159 when not scheduled and informed in advance, on one
160160 of the days when he/she is off duty. When
161161 called in on weekends, Saturdays or Sundays, Holidays, or prior
162162 to an employee's scheduled tour
163163 of duty on Monday, the minimum of four (4) hours of work shall be credited to any employee,
164164 except
165165 as provided in Section B of this Article.
166166 4 Section B:
167167 When an employee is called in before his/her regular tour of duty to perform overtime, a
168168 minimum
169169 of ( 4) four hours of work shall be credited to the employee.
170170 Section C:
171171 If an employee is called while off duty to help troubleshoot a problem, she/he will be paid Four
172172 (4) hours for the first call. There will be no additional compensation for subsequent calls within a
173173 24-hour period until such calls exceed one hour in time.

176176 ON-CALL PAY
177177 An employee may be required to be on call after having completed his/her regular tour of duty.
178178 The Employer shall specify the hours during which the employee
179179 is on call; and shall
180180 compensate the employee at a rate
181181 of twenty-five per cent (25%) of his/her basic rate of pay for
182182 each hour the employee
183183 is on call.
184184 Section B:
185185 For the purpose of this Agreement, "On-Call" is defined as -when an employee is required to
186186 respond to a phone call or page, and be available for work within one (1) hour or sooner, if
187187 possible.
188188 Section C:
189189 The employee's schedule must specify the hours during which he/she shall be required to remain
190190 on call.

192192 ARTICLE 5
193193 ANNUAL LEAVE BUY-OUT
194194 An employee who is separated or is otherwise entitled to a lump-sum payment under personnel
195195 regulations applicable
196196 to DBH shall receive such payment for each hour of unused annual leave
197197 or compensatory time in the employee's official leave record.

199199 5 The lump-sum payment shall be computed on the basis of the employ ee's rate at the time of
200200 separation in accordance with such personnel regulations.

202202 HAZARDOUS DUTY/ENVIRONMENTAL DIFFERENTIAL

205205 Hazardous Duty and Environmental Differential compensation shall be paid in accordance with
206206 the District Personnel Manual and the Comprehensive Merit Personnel Act (CMP A),

210210 changes to the law.
211211 Section B:
212212 This additional compensation will be based on the relevant exposure and not be limited by a
213213 member's position title or position description.

215215 GRIEVANCES
216216 This Compensation Agreement shall be incorporated by reference into the local working
217217 conditions agreement
218218 in order to utilize the grievance/arbitration procedures in such Agreement
219219 to consider alleged violations
220220 of this Agreement.
221221 ARTICLE 8
222222 SICK LEA VE INCENTIVE PROGRAM
223223 Section
224224 A:
225225 In order to recognize an employee's productivity through his/her responsible use of accrued sick
226226 leave, the Employer agrees to provide time-off
227227 in accordance with the following
228228 6 Section B:
229229 1. A full-time employee who is in a pay status for the leave year shall accrue
230230 annually:
231231 a. three (3) days off for utilizing a total of no more than two (2) days of
232232 accrued sick leave.
233233 b. two (2) days for utilizing a total
234234 of no more than two (2), but not more
235235 than four ( 4) days
236236 of accrued sick leave.
237237 c. one (1) day
238238 off for utilizing a total of more than four ( 4 ), but no more than
239239 five (5) days
240240 of accrued sick leave.
241241 Employees in a non-pay status for no more than two (2) pay periods for the leave year shall
242242 remain eligible for incentive days under this Article. Sick leave usage for maternity or
243243 catastrophic illness/injury, not to exceed two (2) consecutive pay periods, shall not be counted
244244 against sick leave for calculating eligibility for incentive leave under this Article.
245245 Section C:
246246 Time off pursuant to a sick leave incentive award shall be selected by the employee and
247247 requested at least three (3) full workdays
248248 in advance of the leave date. Requests for time off
249249 pursuant to an incentive award shall be given priority consideration and the employee's
250250 supervisor shall approve such requests for time
251251 off unless staffing needs or workload
252252 considerations dictate otherwise.
253253 If the request is denied, the employee shall request and be
254254 granted a different day
255255 off within one month of the date the employee initially requested.
256256 Section D:
257257 All incentive days must be used in full-day increments following the leave year in which they
258258 were earned. Incentive days may not be substituted for any other type
259259 of absence from duty.
260260 There shall be no carryover or payment for any unused incentive days.
261261 Section E:
262262 Part-time employees are not eligible for the sick leave incentive as provided in this Article.
263263 Section F:
264264 This program shall be in effect in for the duration of this Agreement.

267267 TRAINING
268268 Requests for employee training outside DBH shall be submitted and authorized using appropriate
269269 D.C. Government Employee Training forms

272272 1. Authorization for funding may be available for tuition expenses only.
273273 Textbooks and other course materials are the responsibility
274274 of the employee seeking training.
275275 Reimbursement for tuition or registration shall be authorized only when equivalent training

277277 offered by DBH, training
278278 is directly related to the employee's current duties at DBH, and the
279279 employee has not previously attended the training. As such, employees receiving training
280280 as a

282282 of their official duties or to retain the employee's license, certification or registration that is
283283 required to maintain the employees current job at DBH, shall be placed on administrative leave
284284 during the time
285285 of their training. The procedures for requesting training are outlined in DBH
286286 Policy 750.2A and must be followed.

288288 DBH Employees are responsible for the cost of licenses and certifications required to maintain
289289 their positions.

291291 ARTICLE 10
292292 UNIFORMS AND GEAR
293293 DBH agrees to make available $600 per fiscal year for uniforms per employee. Every two years
294294 DBH will provide one pair
295295 of OSHA compliant safety boots to all employees except Motor
296296 Vehicle Operators. Safety boots/shoes are
297297 to be worn at all times to ensure the safety of the
298298 employee --
299299 no other shoes are to be worn.
300300 Section B:
301301 In addition, the Employer shall purchase protective gear that is required in each shop, which
302302 includes the following:
303303 1. Head gear,
304304 2. Gloves (as needed),
305305 3. Goggles,
306306 4. Earplugs, and
307307 8 5. High quality boots
308308 Section C:
309309 When employees are required to utilize special safety devices or protective equipment, such will
310310 be furnished at no cost to the employee and maintained and replaced on a fair wear and tear
311311 basis.
312312 Section D:
313313 No government issued equipment, except cell phones, is to be removed from the worksite
314314 without written authorization.
315315 Section E:
316316 Uniforms will be selected during the first quarter of the fiscal year each year during the life of
317317 this Agreement. For FY 2022, unifmms will be selected within 60 days of Council approval.
318318 ARTICLE 11
319319 SAVINGS CLAUSE
320320 Should any provision
321321 of this Agreement be rendered or declared invalid by reason of any existing or
322322 subsequently enacted legislation or by decree
323323 of a court or administrative agency of competent
324324 jurisdiction, such invalidation shall not affect any other part or provision thereof. Where appropriate, the
325325 parties shall meet within 120 days
326326 to negotiate any substitute provision (s).

329329 DISTRIBUTION AND PRINTING OF AGREEMENT
330330 The Employer and the Union shall each be responsible for their cost
331331 of printing this Agreement.

335335 The Employer shall subsidize the cost
336336 of monthly transit passes by fifty dollars ($50.00) per month for
337337 employees who purchase and use such passes to commute to and from work.
338338 9 ARTICLE 14
339339 DURATION AND FINALITY OF AGREEMENT
340340 Section A:
341341 This Agreement shall be in full force and effect from the date this Agreement is signed, and shall
342342 remain in effect through September 30 2024. The Agreement shall be automatically renewed
343343 from year to year thereafter until changed by the parties in the following manner: written notice
344344 by a party
345345 of its desire. to renegotiate this Agreement; such notice to be given during the period
346346 120 days to
347347 90 days prior to the first day of a fiscal year, for the purposes of negotiating a
348348 compensation arid non-compensation agreement for the subsequent fiscal year.
349349 Section B:
350350 It is understood that this Agreement contains the full understanding of the parties as to all
351351 existing matters subject to collective bargaining during the life
352352 of this Agreement. This
353353 Agreement shall not be reconsidered during its life nor shall either party make any changes in
354354 compensation for the duration
355355 of the Agreement unless by mutual consent or as provided
356356 elsewhere in this Agreement or
357357 as required by law.
358358 Section C:
359359 Should any provision of this Agreement be rendered or declared invalid by reason of any existing
360360 or subsequently enacted legislation or by decree
361361 of a court or administrative agency of competent
362362 jurisdiction, such invalidation shall not affect any other part or provision hereof. In that event,
363363 either party shall have the right
