Enclosed for consideration and approval by the Council of the District of Columbia is the 
“Transfer of Jurisdiction of Lots 287 and 998 in Square 5865, Part of Lots 981 and 982 in Square 
5865, Part of Parcel 240/6, Part of Parcel 234/41, and a Portion of Reservation 421, S.O. 14-
20429, Approval Resolution of 2023”. This resolution will approve the transfer of jurisdiction of 
certain real property adjacent to and near the Anacostia Freeway from the U.S. General Services 
Administration and the U.S. Department of the Interior, National Park Service to the District of 
Columbia. 
 
This transfer of jurisdiction is necessary for the completion of the substantial improvements to 
the I-295/Malcolm X Avenue, SE interchange related to the relocation of the Department of 
Homeland Security to the St. Elizabeths Campus.

BE IT RESOLVED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That 
this resolution may be cited

Sec. 
2. Pursuant to section 1 	of An Act To Authorize the Transfer 	of Jurisdiction Over 
Public Land in the District 
of Columbia, approved May 20, 1932 (47 Stat. 161; D.C. Official 
Code § 10-111 
), the Council approves the transfer 	of jurisdiction: 
(a) From the U.S. General Services Administration 
to the District of Columbia over 
approximately 598,814 square feet 
ofland inclusive of Lots 287 and 998 in Square 5865, part 	of 
Lots 981 and 982 in Square 5865, part 	of Parcel 240/6, part of Parcel 234/41, and a portion 	of 
Reservation 421 as shown on plats 2 through 7 in S.O. 14-20429; and 
(b) From the U.S. Department 
of the Interior, National Park Service to the District 	of 
Columbia over approximately 154,017 square feet 	ofland being a portion of U.S. Reservation 
421 
as shown on plats 8 through 18 in S.O. 14-20429.  2 
Sec. 3.  The Council shall transmit a copy of this resolution, upon its adoption, to the 31 
Mayor, Surveyor of the District of Columbia, the District of Columbia Recorder of Deeds, the 32 
Executive Director of the National Capital Planning Commission, the Speaker of the United 33 
States House of Representatives, the President Pro Tempore of the United States Senate, and the 34 
Regional Director of the National Capital Region of the National Park Service. 35 
Sec. 4.  Fiscal impact statement. 36 
The Council adopts the fiscal impact statement of the Chief Financial Officer as the fiscal 37 
impact statement required by section 4a of the General Legislative Procedures Act of 1975, 38 
approved October 16, 1975 (120 Stat. 2038; D.C. Official Code § 1-301.47a). 39

Funds are sufficient in the fiscal year 2023 through fiscal year 2026 budget and financial plan to 
implement the proposed approval resolution.  
 
Background 
 
The District Department of Transportation (DDOT) recently reconstructed the interchange of the 
Anacostia Freeway (295), Malcolm X Avenue, S.E., and South Capitol Street (project interchange) to 
support the development at the St. Elizabeths West Campus. Some components of the reconstruction 
took place on federal land owned by the United States General Services Administration (GSA) and the 
National Park Service (NPS) through a right of entry and permit.  
 
The proposed approval resolution transfers jurisdiction of all or portions of GSA and NPS owned 
lands around the project interchange and that run along the Anacostia Freeway between the 
Anacostia Freeway and Suitland Parkway interchange and the project interchange.

Financial Plan Impact 
 
Funds are sufficient in the fiscal year 2023 through fiscal year 2026 budget and financial plan to 
implement the proposed approval resolution. The District must obtain jurisdiction over the GSA and 
NPS properties in order to operate and maintain the project interchange and to formally close out 
the project. DDOT can absorb any costs associated with receiving jurisdiction over these properties 
within the agency’s existing budgeted resources.

The United States General Services Administration 	(GSA} proposes to transfer jurisdiction of 
approximately 6,522 square feet of land and approximately 17,602 square feet of CSX easements 
in Southeast Washington, DC, to the District of Columbia Department of Transportation (DDOT} 
pursuant to 40 U.S.C. § 8124(a). GSA recently completed the construction of a new access road 
on the western side of the St. Elizabeths West Campus at this location. The new access road 
required a modification 
to the existing intersection at Firth Sterling A venue, SE near Stevens Road, 
SE, to enhance vehicular access to the St. Elizabeths Campus. In order for this work to take place, 
DDOT required GSA to modify several adjoining streets and create an extension of Eaton Road, 
SE to connect it to Barry Road, SE. GSA acquired property from two adjoining owners to create 
the Eaton Road extension. At this time, GSA is transferring jurisdiction of these parcels to DDOT. 
Additionally, to complete the new access road, GSA needed easements from CSX for several areas 
along Firth Sterling A venue, Stevens 	Road, and Eaton Road, SE. GSA is reassigning these 
easements to the District of Columbia government as part of this action as well. 
The transfer of jurisdiction will allow for the intersection to be maintained by DDOT. The transfer 
of jurisdiction 
is consistent with the St. Elizabeths West Campus installation master 	plan and 
relevant policies within the Comprehensive Plan for the National Capital. 
In accordance with the National Environmental Policy 	Act 
(NEPA}, GSA determined that the 
project 
is a categorical exclusion under its environmental regulations 	C.2, for land exchanges that 
will 
not lead to significant changes in the use of land. NCPC staff independently reviewed the 
project information and 
has determined that the project is categorically excluded under Section 
8(c)(22) 
of NCPC's Environmental and Historic Preservation Policies 	and Procedures. 
Specifically 
the categorical exclusion is for the review and approval of land exchanges or transfers 
of jurisdiction that will not lead to anticipated changes in the use ofland and that have no potential 
for environmental impact. 
Pursuant to Section 
106 of the National Historic Preservation Act, GSA consulted on the St. 
Elizabeths West Campus Master Plan with 	the District of Columbia State Historic Preservation 
Office 
(DC SHPO) and other consulting parties which resulted in the execution of a Programmatic  Delegated Action of the Executive Director

Agreement in 2008. GSA continued consultation on the new access road in accordance with the 
PA and executed a Memorandum of Agreement in 2011 to resolve the adverse effects from the 
access road. NCPC designated GSA as lead agency to satisfy 
the Commission's Section 106 
responsibility. NCPC participated in the consultation and 
was a signatory to both the PA and 
Memorandum 
of Agreement regarding the access road. GSA confirmed their determination 	of no 
adverse effect with the 	DC SHPO concerning the new access road prior 	to submitting the transfer 
of jurisdiction for the Commission's review. The DC SHPO concurred with 	GSA's final 
determination 
of effect. 
The Coordinating Committee reviewed the proposal 
at its October 14, 2015 meeting. The 
Committee forwarded the proposed transfer 
of jurisdiction to the Commission with the statement 
that the proposal has been coordinated with all participating agencies except the 
DC SHPO. The 
representative for the DC SHPO noted that 
it needed additional time to review the proposal. Staff 
reviewed the materials 
GSA submitted which included documentation indicating that GSA 
coordinated the project with the 
DC SHPO in April 2015. The participating agencies were: NCPC; 
the District 
of Columbia Office of Planning; the District Department 	of Transportation; the District 
of Columbia State Historic Preservation Office; the National Park Service; the General Services 
Administration and the Washington Metropolitan Area Transit Authority .
