1414 by the Council is the "Certified Business Enterprise Program
1515 Compliance and Enforcement Support Emergency Declaration Resolution
1616 of 2024", the
1717 "Certified Business Enterprise Program Compliance and Enforcement Support Emergency
1818 Amendment Act
1919 of 2024" and the "Certified Business Enterprise Program Compliance and
2020 Enforcement Support Temporary Amendment Act
2121 of 2024."
2222 The resolution and accompanying emergency and temporary bills close gaps in the District's
2323 Certified Business Enterprise (CBE) Program
2424 by making critical amendments to sections 2302,
2525 2346, and 2363
2626 of the Small and Certified Business Enterprise Development and Assistance Act
2727 of 2005 ("the Act").
2828 More specifically, these amendments will:
2929 (l) establish uniform hearing procedures for all
3030 departmental enforcement actions before OAH; (2) expand the scope
3131 of DSLBD's complaint
3232 hotline for the public reporting
3333 of issues beyond allegations of potential certified business
3434 enterprise program fraud; (3) add penalties for any person that violates section 2363
3535 of the Act;
3636 ( 4) increase the penalty for beneficiaries who fail
3737 to show commercially reasonable best efforts
3838 to meet required CBE subcontracting requirements; (5) establish minimum periods
3939 of
4040 departmental suspensions and revocations for violations under the Act; and ( 6) expand the
4141 statutory definition
4242 of "beneficiary" to include non-profit entities, ensuring that all prime
4343 contractors on government-assisted projects are subject to the Act's CBE subcontracting and
4444 reporting requirements.
4545 These necessary, time-sensitive changes will allow the District to more effectively and
4646 efficiently enforce the District's CBE compliance requirements.

8282 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
8383 28 resolution may be cited as the "Certified Business Enterprise Program Compliance and
8484 29 Enforcement Support Emergency Declaration Resolution of 2024".
8585 30 Sec. 2. (a) A Certified Business Enterprise (CBE) is a business enterprise certified by the
8686 31 Department of Small and Local Business Development (DSLBD) as a local business enterprise.
8787 32 (b) Businesses with CBE certification may receive preference when submitting bids or
8888 33 proposals for procurement and contracting opportunities. (c) There are currently over 2,000 businesses participating in the District’s CBE 34
8989 Program. 35
9090 (d) Following a recent revocation hearing before the Office of 36
9191 Administrative Hearings (OAH), DSLBD determined that certain time -sensitive amendments 37
9292 were necessary to ensure increased effectiveness and efficiency in departmental compliance and 38
9393 enforcement procedures. 39
9494 (e) Time-sensitive items include (1) establishing uniform hearing procedures for all 40
9595 departmental enforcement actions before the Office of A dministrative Hearings, (2) expanding 41
9696 the scope of the Department’s complaint hotline for the public reporting of issues in addition to 42
9797 allegations of potential certified business enterprise program fraud, (3) t he addition of penalties 43
9898 for any business enterprise that violates section 2363 of the A ct, (4) increasing the penalty for 44
9999 beneficiaries who fail to show commercially reasonable best efforts to meet required certified 45
100100 business enterprise subcontracting requirements, (5) establishing minimum periods of 46
101101 departmental suspensions and revocations for violations under the act, (6) the addition of critical 47
102102 definitions for the terms “person” and “principal office,” and (7) the expansion of the statutory 48
103103 definition of “beneficiary” to include non- profit entities to ensure that all prime contractors and 49
104104 developers on government -assisted projects are subject to the Act’s CBE subcontracting and 50
105105 reporting requirements . 51
106106 (f) Accordingly, emergency legislation is needed to clarify and update procedures and 52
107107 penalties under section 2363 of the A ct. 53
108108 (g) Failure to move these amendments will have an adverse effect on agency operations 54
109109 as well as agency compliance and enforcement mechanisms. 55 Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 56
110110 emergency circumstances making it necessary that the Certified Business Enterprise Program 57
111111 Compliance and Enforcement Support Emergency Amendment Act of 2024 be adopted after a 58
112112 single reading. 59
113113 Sec. 4. The Secretary of the Council shall transmit a copy of this resolution, upon its 60
114114 adoption, to the Mayor of the District of Columbia. 61
115115 Sec. 5. This resolution shall take effect immediately. 62
