17-To declare the existence of an emergency with respect to the need to confirm the appointment of
18-Sharon Kershbaum as the Director of the District Department of Transportation.

20-RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
21-resolution may be cited as the “Director of the District Department of Transportation Sharon
22-Kershbaum Confirmation Emergency Declaration Resolution of 2024”.

24-Sec. 2. (a) By law, the District Department of Transportation (“DDOT”) must be led by a
25-Director that is appointed by the Mayor and confirmed by the Council. After the departure of
26-former DDOT Director Everett Lott in October 2023, Sharon Kershbaum served as the agency’s
27-Interim, and now Acting, Director.
28-(b) On April 10, 2024, Chairman Mendelson introduced PR25-0723, the Director of the
29-District Department of Transportation Sharon Kershbaum Confirmation Resolution of 2024, at
30-the request of the Mayor. PR25-0723 would confirm Acting Director Kershbaum’s appointment
31-as the permanent Director for the District Department of Transportation. PR25-0723 will be
32-deemed approved on September 22, 2024.
33-(c) PR25-0723 was referred to the Committee on Transportation and the Environment on
34-April 23, 2024 and the Committee held a public roundtable on the measure on June 20, 2024.
35-Although the Committee voted to approve PR25-0723 at its September 16, 2024 additional
36-meeting, the Committee will not have filed its report in time for the Council to consider the
37-measure at the September 17, 2024 legislative meeting.
38-(d) If the Council does not vote on Acting Director Kershbaum’s nomination at the
39-September 17, 2024 legislative meeting, PR25-0723 will be deemed approved without the
40-Council affirmatively acting on her nomination. Given the important role that the Director of
41-DDOT plays in overseeing the design and construction of transportation projects, building safer
42-streets, and transforming public spaces for the community to enjoy, the full Council should have
43-an opportunity to consider and vote on Ms. Kershbaum’s nomination.

45-Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
