14 | 14 | | Today, I am introducing the “Neighborhood Management Authority Act of 2025”, legislation |
---|
15 | 15 | | that creates a framework for safe and vibrant communities on a hyper-local level. A Neighborhood |
---|
16 | 16 | | Management Authority established by this bill would provide enhancements to clean and safe programs, |
---|
17 | 17 | | support businesses and cultural destinations, maintain public spaces, manage public assets, and would |
---|
18 | 18 | | help coordinate D.C. government services for maximum efficiency. The legislation establishes two |
---|
19 | 19 | | Neighborhood Management Authorities – one for the Greater U Street Corridor and one for Columbia |
---|
20 | 20 | | Heights. |
---|

---|
22 | 22 | | While 14th and U is often synonymous with D.C.’s 21st century surge in economic development |
---|
23 | 23 | | and population, in many ways the corridor remains under-invested. The area was the subject of a 2004 |
---|
24 | 24 | | small area plan – referred to as the “DUKE Plan” in homage to Duke Ellington – which focused on |
---|
25 | 25 | | supporting music, arts, and culture, equitable growth and development, and continuing the legacy of U |
---|
26 | 26 | | Street as Black Broadway. While some progress has been made on that plan’s recommendations, it is not |
---|
27 | 27 | | yet fully realized. Public sector resources and services have not kept up with U Street’s substantial |
---|
28 | 28 | | private development and continued growth as a nightlife destination. This has led to serious safety |
---|
29 | 29 | | concerns and an overall feeling of disorder shared by a diverse group of residents and business owners. |
---|

31 | 31 | | In 2022, I launched the U Street Safety Initiative, a planning effort led by my office to deeply |
---|
32 | 32 | | engage residents and businesses in the Greater U Street Corridor and provide recommendations and a |
---|
33 | 33 | | clear road map for improving public safety and vibrancy in the area. That effort reached over 300 |
---|
34 | 34 | | residents and business owners through surveys, focus groups, and interviews; my office published |
---|
35 | 35 | | recommendations in November 2022. Columbia Heights, meanwhile, has seen considerable growth and change of its own, with |
---|
36 | 36 | | services that simply have not kept pace. Central Columbia Heights has the highest consistent pedestrian |
---|
37 | 37 | | activity in the District and public spaces like Columbia Heights Civic Plaza, now about 20 years old, are |
---|
38 | 38 | | straining under the weight of community needs and have recurring issues with safety and basic |
---|
39 | 39 | | maintenance. |

41 | 41 | | As part of my response, I funded an expansive initiative led by the Office of Planning: the |
---|
42 | 42 | | Columbia Heights/Mount Pleasant Public Life Study. This work focused on studying the use of public |
---|
43 | 43 | | spaces, supporting successful implementation of the newly-established sidewalk vending zone, and |
---|
44 | 44 | | creating a cohesive design for streets, sidewalks, and public spaces. |
---|

46 | 46 | | The U Street Safety Initiative and the Public Life Study covering Columbia Heights share one |
---|
47 | 47 | | very clear recommendation: These neighborhoods each need their own place management entity in order |
---|
48 | 48 | | to truly thrive. |
---|

---|
50 | 50 | | As introduced, this legislation establishes an overall structure for a Neighborhood Management |
---|
51 | 51 | | Authority as an instrumentality of D.C. government. The legal structure is similar to public authorities |
---|
52 | 52 | | we have already, such as the DC Green Bank or Events DC. |
---|

---|
54 | 54 | | The bill then creates two separate Neighborhood Management Authorities in Columbia Heights |
---|
55 | 55 | | and the “Duke District” (acknowledging the overlap of several neighborhoods, and a callback to the |
---|
56 | 56 | | DUKE Plan). Each authority has a governing board of directors comprised of a mix of resident and |
---|
57 | 57 | | commercial representatives. While these are the first two authorities established, the bill is drafted so |
---|
58 | 58 | | that other neighborhoods might adopt this model in the future. |
---|

---|
60 | 60 | | Each Authority is given dedicated funding sources to ensure its success and sustainability. These |
---|
61 | 61 | | revenue sources can be tailored to fit the economic dynamics of each neighborhood. As an example, the |
---|
62 | 62 | | Greater U Street Performance Parking Zone went live at the end of 2024, and that new meter revenue |
---|
63 | 63 | | will be reinvested back in the neighborhood; Columbia Heights had a performance parking zone of its |
---|
64 | 64 | | own, which this measure re-establishes. I am proud to be able to advance a proposal enhancing |
---|
65 | 65 | | neighborhood services that does not rely on increasing property taxes to fund. |

128 | 128 | | TITLE I. GENERAL PROVISIONS. 3 |
---|
129 | 129 | | Sec. 102. Formation. 4 |
---|
130 | 130 | | Each Neighborhood Management Authority shall be organized as an instrumentality of 5 |
---|
131 | 131 | | the District Government, which shall have a separate legal existence within the District 6 |
---|
132 | 132 | | Government. 7 |
---|
133 | 133 | | Sec. 103. Powers. 8 |
---|
134 | 134 | | Each Neighborhood Management Authority (“Authority”) established pursuant to this act 9 3 |
---|
135 | 135 | | shall have the power to: 10 |
---|
136 | 136 | | (1) Sue and be sued in its name; 11 |
---|
137 | 137 | | (2) Adopt a seal and alter the seal at its pleasure; 12 |
---|
138 | 138 | | (3) Adopt, amend, and repeal bylaws governing the manner in which it may conduct 13 |
---|
139 | 139 | | business and how the powers vested in it may be exercised; 14 |
---|
140 | 140 | | (4) Borrow money for any of its purposes, as may be permitted under Chapter 2 of Title 1 15 |
---|
141 | 141 | | and other laws of the District; provided, that the Authority’s debts shall not be subject to and 16 |
---|
142 | 142 | | shall not be backed by the full faith and credit of the District of Columbia; 17 |
---|
143 | 143 | | (5) To issue bonds and to give security pursuant to section 112 of this Act; provided, that 18 |
---|
144 | 144 | | the Authority's debts shall not be backed by the full faith and credit of the District of Columbia; 19 |
---|
145 | 145 | | (6) To provide for the payment of obligations as may be permitted under the Home Rule 20 |
---|
146 | 146 | | Act, and other laws of the District; 21 |
---|
147 | 147 | | (7) To the extent permitted under its contracts with bond holders of the Authority, to 22 |
---|
148 | 148 | | consent to any modification with respect to rate of interest, time and payment of any installment 23 |
---|
149 | 149 | | of principal or interest, security or any other term of any contract, loan, loan commitment, or 24 |
---|
150 | 150 | | contract or agreement of any kind to which the Authority is a party; 25 |
---|
151 | 151 | | (8) To employ officers, executives, and management personnel who may: 26 |
---|
152 | 152 | | (A) Formulate or participate in the formulation of the plans, policies, and 27 |
---|
153 | 153 | | standards; 28 |
---|
154 | 154 | | (B) Administer, manage, or operate the Authority, fix their qualifications, and 29 |
---|
155 | 155 | | prescribe their duties and other terms of employment, compensation, and benefits; and 30 |
---|
156 | 156 | | (C) Employ other personnel as may be necessary; 31 |
---|
157 | 157 | | (9) To retain or employ advisers, consultants, and agents, including financial advisers, 32 4 |
---|
158 | 158 | | appraisers, accountants, auditors, engineers, private consultants, and legal counsel for rendering 33 |
---|
159 | 159 | | professional, management, or technical services and advice, and to fix their compensation; 34 |
---|
160 | 160 | | (10) Establish polices for contracting and procurement that are consistent with the 35 |
---|
161 | 161 | | principles of competitive procurement and, subject to District law, make and execute contracts, 36 |
---|
162 | 162 | | leases, and all other agreements or instruments necessary and appropriate for the exercise of its 37 |
---|
163 | 163 | | powers and the fulfillment of its purposes; 38 |
---|
164 | 164 | | (11) To enter into contracts, memorandums of understanding, and other financing 39 |
---|
165 | 165 | | agreements with any department, agency, or instrumentality of the United States or the District 40 |
---|
166 | 166 | | and private parties; and 41 |
---|
167 | 167 | | (12) Notwithstanding other provisions of law and subject to Council approval by 42 |
---|
168 | 168 | | resolution, acquire, construct, and dispose of real or personal property of every kind. 43 |
---|
169 | 169 | | Sec. 104. Budget formulation and transparency. 44 |
---|
170 | 170 | | (a) The Board shall prepare and submit to the Mayor an operating budget on the date that 45 |
---|
171 | 171 | | District departments and agencies are required to submit proposed budgets to the Mayor. Prior to 46 |
---|
172 | 172 | | submission to the Mayor, the proposed operating budget must be certified by the Chief Financial 47 |
---|
173 | 173 | | Officer of the District of Columbia as being balanced. 48 |
---|
174 | 174 | | (b) The Authority shall contract at least once each year with an independent certified 49 |
---|
175 | 175 | | public accountant to audit its books and accounts. Within 10 days after receiving the results of 50 |
---|
176 | 176 | | the audit from the independent certified public accountant, the Authority shall transmit the 51 |
---|
177 | 177 | | results of the audit to the Mayor and Council and shall make the audit available to the public on 52 |
---|
178 | 178 | | its website. 53 |
---|
179 | 179 | | (c) At least once per year, the Authority Board shall hold a public hearing on the 54 |
---|
180 | 180 | | Authority's performance. The Authority Board shall publish notice of the hearing on the 55 5 |
---|
181 | 181 | | Authority's website and in the District of Columbia Register at least 14 calendar days before the 56 |
---|
182 | 182 | | hearing, and the hearing shall be recorded by electronic means. Within 3 days after the hearing, 57 |
---|
183 | 183 | | the recording of the hearing and all written submitted testimony shall be made public on the 58 |
---|
184 | 184 | | Authority's website. 59 |
---|
185 | 185 | | Sec. 105. Board of Directors. 60 |
---|
186 | 186 | | (a) Each Neighborhood Management Authority shall be governed by a Board of Directors 61 |
---|
187 | 187 | | (“Board”), with voting and nonvoting members allocated pursuant to Title II. The powers of the 62 |
---|
188 | 188 | | Authority shall be vested in the Board. A majority of the incumbent voting Board members shall 63 |
---|
189 | 189 | | constitute a quorum for the transaction of business, and an affirmative vote of a majority of 64 |
---|
190 | 190 | | voting members shall be necessary for valid Authority action. 65 |
---|
191 | 191 | | (b) Notwithstanding any other provision of law, the Mayor shall transmit to the Council, 66 |
---|
192 | 192 | | for a 30-day period of review, excluding days of Council recess, nominations to a Neighborhood 67 |
---|
193 | 193 | | Management Authority as prescribed in Title II. If the Council does not approve by resolution 68 |
---|
194 | 194 | | within the 30-day period, the nomination shall be deemed approved. 69 |
---|
195 | 195 | | (c) Except as otherwise provided, appointed Board members shall serve for a term of 3 70 |
---|
196 | 196 | | years. 71 |
---|
197 | 197 | | (1) The term of a Board member appointed by an Advisory Neighborhood 72 |
---|
198 | 198 | | Commission shall expire on January 2 of any year that follows a general election. 73 |
---|
199 | 199 | | (d) Any voting member of the Board shall be eligible for reappointment, provided that no 74 |
---|
200 | 200 | | person may be nominated to serve more than two consecutive terms. 75 |
---|
201 | 201 | | (e) A person appointed to fill a vacancy on the Board shall be appointed only for the 76 |
---|
202 | 202 | | unexpired term of the Board member whose vacancy is being filled. 77 |
---|
203 | 203 | | (f) A voting member appointed by the Mayor or Council whose term has expired may 78 6 |
---|
204 | 204 | | continue to serve for 180 days after the voting member's term expires, or until their replacement 79 |
---|
205 | 205 | | is appointed, whichever occurs first. 80 |
---|
206 | 206 | | (g) The voting members of the Board shall elect, by a majority vote, one of the voting 81 |
---|
207 | 207 | | members to serve as chairperson. 82 |
---|
208 | 208 | | (h) A Board member shall not be entitled to compensation but may be reimbursed for 83 |
---|
209 | 209 | | actual and necessary expenses while engaged in official duties of the Authority, including 84 |
---|
210 | 210 | | transportation, parking, mileage expenses, and conference admission fees incurred. 85 |
---|
211 | 211 | | (i) Unless prohibited by law, a Board member may engage in private employment, a 86 |
---|
212 | 212 | | profession, or a business. 87 |
---|
213 | 213 | | (j) A Board member shall not be held personally liable for an action taken in good faith 88 |
---|
214 | 214 | | during the course of his or her official duties. 89 |
---|
215 | 215 | | (k) The appointing authority or the Board may remove a member of the Board for 90 |
---|
216 | 216 | | inefficiency, neglect of duty or misconduct in office, after giving the member a copy of the 91 |
---|
217 | 217 | | charges against them and an opportunity to be heard in person or by counsel in their defense 92 |
---|
218 | 218 | | upon not less than 10 days’ notice. 93 |
---|
219 | 219 | | (1) Removal of a member by action of the Board shall require an affirmative vote 94 |
---|
220 | 220 | | of 2/3 of members. If a member is removed by the Board, the Board shall promptly notify the 95 |
---|
221 | 221 | | Mayor and the Council of the action. Within 30 days after a vacancy occurs or a term expires, the 96 |
---|
222 | 222 | | Mayor shall nominate someone to fill the vacancy or begin the new term. The member shall hold 97 |
---|
223 | 223 | | office for the term of his appointment and shall serve until a successor has qualified. 98 |
---|
224 | 224 | | (l) Members of the Board may participate in a meeting of the Board or a committee 99 |
---|
225 | 225 | | thereof by means of conference telephone or similar communication equipment so long as all 100 |
---|
226 | 226 | | Board members participating in the meeting and members of the public can be heard by each 101 7 |
---|
227 | 227 | | other. No vacancy in the membership of the Board shall impair the right of a quorum to exercise 102 |
---|
228 | 228 | | all rights and perform all duties of the Agency. 103 |
---|
229 | 229 | | Sec. 106. Director Appointment and Duties. 104 |
---|
230 | 230 | | (a) The Board, by majority vote, shall employ a Director to run the day-to-day affairs of 105 |
---|
231 | 231 | | the Authority. The Director shall be a resident of the District and shall remain a District resident 106 |
---|
232 | 232 | | for the duration of his or her employment by the Authority. Failure to maintain District residency 107 |
---|
233 | 233 | | shall result in a forfeiture of the position. 108 |
---|
234 | 234 | | (b) The Director shall perform the following duties and responsibilities: 109 |
---|
235 | 235 | | (1) Assist in the preparation of the budgets and annual reports; 110 |
---|
236 | 236 | | (2) Administer all operating policies, rules, and regulations adopted by the Board; 111 |
---|
237 | 237 | | (3) Employ personnel; 112 |
---|
238 | 238 | | (4) Perform such other duties as may be authorized by the Board for the effective 113 |
---|
239 | 239 | | and efficient management of the Authority and its facilities. 114 |
---|
240 | 240 | | (c) The termination of the Director shall require the concurrence of a majority of the 115 |
---|
241 | 241 | | Board. 116 |
---|
242 | 242 | | Sec. 106. Representation and Indemnification. 117 |
---|
243 | 243 | | (a) The officers and employees of the Authority shall not be considered District 118 |
---|
244 | 244 | | government employees for purposes of the District of Columbia Employee Non-liability Act, 119 |
---|
245 | 245 | | approved July 14, 1960 (74 Stat. 519; D.C. Official Code § 2-411 et seq.), and the District of 120 |
---|
246 | 246 | | Columbia shall not be liable for any acts or occurrences of the Authority regardless of whether 121 |
---|
247 | 247 | | the Authority purchases insurance or whether purchased insurance covers any this act or 122 |
---|
248 | 248 | | omission of an this act. 123 |
---|
249 | 249 | | (b) The District of Columbia may, upon request by the Authority and at the discretion of 124 8 |
---|
250 | 250 | | the Attorney General for the District of Columbia (“Attorney General”), provide representation 125 |
---|
251 | 251 | | through the Office of the Attorney General to the Authority and its officers and employees for 126 |
---|
252 | 252 | | legal matters related to their official duties. 127 |
---|
253 | 253 | | (c) The Authority may retain outside counsel, other than the Attorney General, at its own 128 |
---|
254 | 254 | | expense to provide representation for the Authority and its officers and employees in actual or 129 |
---|
255 | 255 | | anticipated litigation related to their official duties and functions or in any other legal 130 |
---|
256 | 256 | | proceeding, lawsuit, grievance, or arbitration filed against the Authority, its officers, or its 131 |
---|
257 | 257 | | employees. 132 |
---|
258 | 258 | | (d) The District of Columbia and its officers and employees shall not be liable for and 133 |
---|
259 | 259 | | may not be made a party to any lawsuits or claims arising from the operation of the Authority. 134 |
---|
260 | 260 | | Sec. 107. Applicability of certain laws. 135 |
---|
261 | 261 | | (a) The Procurement Practices Reform Act of 2010, effective April 8, 2011 (D.C. Law 136 |
---|
262 | 262 | | 18-371; D.C. Official Code § 2-351.01 et seq.), and its implementing regulations, shall not apply 137 |
---|
263 | 263 | | to the Authority. 138 |
---|
264 | 264 | | (b) The Open Meetings Act, effective March 31, 2011 (D.C. Law 18-350; D.C. Official 139 |
---|
265 | 265 | | Code § 2-571 et seq.), shall apply to the Authority. 140 |
---|
266 | 266 | | (c) Title I of the District of Columbia Administrative Procedure Act, approved October 141 |
---|
267 | 267 | | 21, 1968 (82 Stat. 1204; D.C. Official Code § 2-501 et seq.), and the regulations implementing 142 |
---|
268 | 268 | | those provisions, shall not apply to the Authority. 143 |
---|
269 | 269 | | (d) The Small and Certified Business Enterprise Development and Assistance Act of 144 |
---|
270 | 270 | | 2005, effective October 20, 2005 (D.C. Law 16-33; D.C. Official Code § 2-218.01 et seq.), and 145 |
---|
271 | 271 | | its implementing regulations, shall not apply to the Authority. 146 |
---|
272 | 272 | | (e) The First Source Employment Contract Act of 1984, effective June 29, 1984 (D.C. 147 9 |
---|
273 | 273 | | Law 5-93; D.C. Official Code § 2-219.01 et seq.), shall not apply to the Authority. 148 |
---|
274 | 274 | | (f) The Code of Conduct, as that term is defined in section 101(7) of the Board of Ethics 149 |

275 | 275 | | and Government Accountability Establishment and Comprehensive Ethics Reform Amendment 150 |
---|

291 | 291 | | Authority’s boundaries, including employees of Main Street, Clean Team, or community 166 |

293 | 293 | | Sec. 108. Prohibitions. 168 |
---|
294 | 294 | | (a) The Authority shall not: 169 |
---|
295 | 295 | | (1) Exercise any police or general power of the District, except those expressly 170 10 |

296 | 296 | | authorized by law; or, 171 |
---|
297 | 297 | | (2) Exercise the power of eminent domain; 172 |
---|
298 | 298 | | (b) All land and improvements acquired by the Authority shall be held in the name of the 173 |
---|
299 | 299 | | Authority, except that title to the property shall not be transferred by the Authority to any person 174 |
---|
300 | 300 | | or entity other than the District government. 175 |
---|
301 | 301 | | (c) The District government shall not eliminate or reduce the level of any services 176 |
---|
302 | 302 | | customarily provided in the District to any similar geographic area because such area is within 177 |
---|
303 | 303 | | the Authority boundaries and shall continue to provide its customary services and levels of each 178 |
---|
304 | 304 | | service to such area unless a reduction in service is part of a District-wide pro rata reduction in 179 |
---|
305 | 305 | | services necessitated by fiscal considerations or budgetary priorities. 180 |
---|
306 | 306 | | Sec. 109. Authority of the Chief Financial Officer. 181 |

307 | 307 | | The CFO shall exercise authority over the Authority consistent with section 424 of the 182 |
---|
308 | 308 | | Home Rule Act. 183 |
---|
309 | 309 | | Sec. 110. BID Formation Within Neighborhood Management Authority Boundaries. 184 |
---|
310 | 310 | | (a) An additional real property tax or possessory interest tax may be assessed and levied 185 |
---|
311 | 311 | | by the District on, and payable by, the owners of taxable properties or holders of a possessory 186 |
---|
312 | 312 | | interest within Authority Boundaries as established in Title II of this act. 187 |
---|
313 | 313 | | (1) For the purposes of this section, “special assessment participants” means 188 |
---|
314 | 314 | | owners, or principals, agents, partners, managers, trustees, stockholders, officers, or directors of 189 |
---|
315 | 315 | | owners of taxable properties, or holders of a possessory interest, and commercial tenants within 190 |
---|
316 | 316 | | an established special assessment area. 191 |
---|
317 | 317 | | (b) In order to implement an assessment pursuant to this section, an application shall be 192 |
---|
318 | 318 | | submitted by one or more owners of taxable property within the Authority to the Board for 193 11 |
---|
319 | 319 | | consideration. The application shall be duly sworn under oath before a notary public who holds a 194 |
---|
320 | 320 | | valid license in the District, and shall contain: 195 |
---|
321 | 321 | | (1) A statement setting forth the name and address of the applicants; 196 |
---|
322 | 322 | | (2) A statement signed by the owners (or their authorized representatives) who 197 |
---|
323 | 323 | | own at least a 51% interest in the most recent assessed value of the taxable properties in the 198 |
---|
324 | 324 | | geographic area of the proposed assessment area as a whole, and at least 25% in number of the 199 |
---|
325 | 325 | | individual taxable properties of record in the assessment area as a whole; 200 |
---|
326 | 326 | | (3) A tax assessor’s map of the geographic area comprising the assessment area, 201 |
---|
327 | 327 | | clearly designating the boundaries and each property by street address, lot, and square number to 202 |
---|
328 | 328 | | be included within the assessment area; 203 |
---|
329 | 329 | | (4) A list, by street address, lot, and square number, of all taxable property within 204 |
---|
330 | 330 | | the proposed special assessment area; and the most recent assessed value of each taxable 205 |
---|
331 | 331 | | property to the extent reasonably ascertainable from District property tax records or a final 206 |
---|
332 | 332 | | determination of the Real Property Tax Appeals Commission for the District of Columbia, and a 207 |
---|
333 | 333 | | list of the names and addresses of all record owners and commercial tenants within the proposed 208 |
---|
334 | 334 | | special assessment area, to the extent reasonably ascertainable; 209 |
---|
335 | 335 | | (A) For the purposes hereof, individual taxable properties shall mean 210 |
---|
336 | 336 | | properties identified by separate lot and square numbers to the extent reasonably ascertainable 211 |
---|
337 | 337 | | from the records of the Office of Taxation and Revenue or Office of Recorder of Deeds; 212 |
---|
338 | 338 | | provided, that any property subdivided into separate condominium units shall constitute a single 213 |
---|
339 | 339 | | property for the purpose of determining the number of taxable properties referred to in this 214 |
---|
340 | 340 | | paragraph; provided further, that such condominium units shall constitute separate properties for 215 |
---|
341 | 341 | | purposes of assessing special assessment area charges. Changes in the assessed values occurring 216 12 |
---|
342 | 342 | | after submission of an application, whether through regular reassessment, appeals, or otherwise, 217 |
---|
343 | 343 | | shall not affect the validity of the application; and, 218 |
---|
344 | 344 | | (5) The annual proposed total special assessment taxes for the first year of 219 |
---|
345 | 345 | | collections, and the formula used to determine each special assessment participant’s tax, which 220 |
---|
346 | 346 | | shall be based upon either assessed value, square footage, or a uniform fixed tax per building. 221 |
---|
347 | 347 | | Special assessment taxes may vary by class and type of property provided that they are applied 222 |
---|
348 | 348 | | fairly and equitably within the assessment area; 223 |
---|
349 | 349 | | (c) The application shall be considered approved by a 2/3 vote of voting members the 224 |
---|
350 | 350 | | Board at a meeting called for such purposes. The Board shall submit legislation effectuating the 225 |
---|
351 | 351 | | application to Council for consideration and approval. 226 |
---|
352 | 352 | | (d) If a portion of the special assessment area boundary falls outside of the boundaries of 227 |
---|
353 | 353 | | the Authority, approval of the special assessment area application by the Authority pursuant to 228 |
---|
354 | 354 | | this section shall constitute an expansion of the Authority’s boundaries. 229 |
---|
355 | 355 | | (e) No later than 120 days after approval of a special assessment area pursuant to this 230 |
---|
356 | 356 | | section, the Authority shall amend its bylaws and procedures to incorporate special assessment 231 |
---|
357 | 357 | | participants in the Authority’s governance, including: 232 |
---|
358 | 358 | | (1) Nomination and election of special assessment participants to fill Board seats 233 |
---|
359 | 359 | | enumerated in Title II of this act; 234 |
---|
360 | 360 | | (2) Procedures for expanding the special assessment area; and, 235 |
---|
361 | 361 | | (3) A process for special assessment participants to vote on amendments to the 236 |
---|
362 | 362 | | special assessment rates and formula. 237 |
---|
363 | 363 | | (f) The special assessment shall be collected pursuant to procedures identical to those 238 |
---|
364 | 364 | | enumerated in section 16 of the Business Improvement Districts Act of 1996, effective May 29, 239 13 |
---|
365 | 365 | | 1996 (D.C. Law 11-134; D.C. Official Code § 2-1215.15). 240 |
---|
366 | 366 | | (g) The Mayor shall not hold a hearing on, or approve for registration, any BID 241 |
---|
367 | 367 | | corporation application, as described in sections 6 and 7 of the Business Improvement Districts 242 |
---|
368 | 368 | | Act of 1996, effective May 29, 1996 (D.C. Law 11-134; D.C. Official Code § 2-1215.05) that 243 |
---|
369 | 369 | | overlaps, in whole or in part, with the boundary of a Neighborhood Management Authority 244 |
---|
370 | 370 | | established pursuant to this act. 245 |
---|
371 | 371 | | Sec. 111. Service Areas and Expansion of Boundaries. 246 |
---|
372 | 372 | | (a) Each Authority shall have its initial boundaries established according to Title II of this 247 |
---|
373 | 373 | | act. 248 |
---|
374 | 374 | | (b) Notwithstanding section 110, the boundaries of the Authority may be expanded by 249 |
---|
375 | 375 | | submitting an application to the Board of Directors, which shall be approved by a 2/3 vote of the 250 |
---|
376 | 376 | | voting members of the Board. The Board shall submit any approved applications for expansion 251 |
---|
377 | 377 | | for Council review by resolution, which shall be deemed approved after a 45-day period of 252 |
---|
378 | 378 | | review, excluding weekends, holidays, and days of Council recess. 253 |
---|
379 | 379 | | (1) The application shall be duly sworn under oath before a notary public who 254 |
---|
380 | 380 | | holds a valid license in the District, and shall contain: 255 |
---|
381 | 381 | | (A) A statement setting forth the name and address of the applicants; 256 |

384 | 384 | | who own at least a 51% interest properties in the geographic area of the proposed assessment 259 |

---|
386 | 386 | | (D) A description of the service needs for the proposed area of expansion, 261 |
---|
387 | 387 | | and whether the proposed expansion would result in an increase in dedicated revenues for the 262 14 |
---|
388 | 388 | | Authority; 263 |
---|
389 | 389 | | (E) An explanation of why the proposed expansion would be consistent 264 |
---|
390 | 390 | | with the purposes of the Authority and with the existing boundary. 265 |
---|
391 | 391 | | Sec. 112. Bond Issuance. 266 |
---|
392 | 392 | | (a) The Authority, pursuant to section 490(a)(6) of the Home Rule Act, may, to carry out 267 |
---|
393 | 393 | | the authorized purposes of the Authority: 268 |
---|
394 | 394 | | (1) Incur debt by the issuance of revenue bonds; and 269 |
---|
395 | 395 | | (2) Borrow or lend money to finance or assist in the financing of undertakings 270 |
---|
396 | 396 | | authorized by this chapter. 271 |
---|
397 | 397 | | (b) The Authority may not use the proceeds of bonds issued by the Authority unless the 272 |
---|
398 | 398 | | Board: 273 |
---|
399 | 399 | | (1) Determines that the use of the proceeds meets the requirements of this chapter 274 |
---|
400 | 400 | | and § 1-204.90; and 275 |
---|
401 | 401 | | (2) Approves a resolution, describing the determination required by paragraph (1) 276 |
---|
402 | 402 | | of this subsection. 277 |
---|
403 | 403 | | (c) Regardless of their form or character, bonds and other debt instruments of the 278 |
---|
404 | 404 | | Authority are negotiable instruments for all purposes of Subtitle I of Title 28, subject only to the 279 |
---|
405 | 405 | | provisions of the bonds for registration. 280 |
---|
406 | 406 | | (d) No director, employee, or agent of the Authority shall be personally liable for any 281 |
---|
407 | 407 | | payment required to be made under any bond issued by the Authority. 282 |
---|
408 | 408 | | (e) No notice, proceeding, consent, or approval shall be required for the issuance or 283 |
---|
409 | 409 | | performance of any bond of the Authority or the execution of any instrument relating thereto or 284 |
---|
410 | 410 | | to the security therefor, except as provided in this chapter or in guidelines issued by the 285 15 |
---|

---|
412 | 412 | | (f) The Authority may stipulate by resolution the terms for sale of its bonds in accordance 287 |
---|
413 | 413 | | with this chapter, including the following: 288 |
---|

415 | 415 | | (2) The date a bond matures; 290 |
---|
416 | 416 | | (3) Whether bonds are issued as serial bonds, as term bonds, or as a combination 291 |
---|

418 | 418 | | (4) The denomination; 293 |
---|
419 | 419 | | (5) The interest rate or rates, or variable rate or rates changing from time to time 294 |
---|
420 | 420 | | in accordance with a base or formula; 295 |

421 | 421 | | (6) The registration privileges; 296 |
---|
422 | 422 | | (7) The medium and method for payment; and 297 |
---|
423 | 423 | | (8) The terms of redemption. 298 |

424 | 424 | | (g) The Authority may sell its bonds at public or private sale and may determine the price 299 |
---|
425 | 425 | | for sale. 300 |

426 | 426 | | (h) A pledge of the Authority is binding from the time it is made. Any funds or property 301 |
---|
427 | 427 | | pledged are subject to the lien of a pledge without physical delivery. The lien of a pledge is 302 |
---|
428 | 428 | | binding as against parties having any tort, contract or other claim against the Authority 303 |
---|
429 | 429 | | regardless of notice. Neither a resolution nor any other instrument creating a pledge need be 304 |
---|
430 | 430 | | recorded. 305 |
---|
431 | 431 | | (i) Bonds issued under the provisions of this section do not constitute an obligation of the 306 |
---|
432 | 432 | | District and are payable solely from the revenues or assets of the Authority. Each bond issued 307 |
---|
433 | 433 | | under this section must contain on its face a statement that the Authority is not obligated to pay 308 16 |
---|
434 | 434 | | principal or interest except from the revenues or assets pledged and that neither the faith and 309 |
---|
435 | 435 | | credit nor the taxing power of the District is pledged to the payment of the principal or interest 310 |
---|
436 | 436 | | on a bond. 311 |

437 | 437 | | (j) The District pledges to the holders of any bonds issued under this section that the 312 |
---|
438 | 438 | | District will not limit or alter rights vested in the Authority to fulfill agreements made with 313 |
---|
439 | 439 | | holders of the bonds, or in any way impair the rights and remedies of the holders of the bonds 314 |
---|
440 | 440 | | until the bonds, together with the interest thereon, with interest on any unpaid installments of 315 |
---|
441 | 441 | | interest, and all costs and expenses in connection with any action or proceedings by or on behalf 316 |
---|
442 | 442 | | of such holders are fully met and discharged. The Authority may include this pledge of the 317 |
---|
443 | 443 | | District in any agreement with the holders of bonds. 318 |

444 | 444 | | (k) The signature of any officer of the Authority that appears on a bond remains valid if 319 |
---|
445 | 445 | | that person ceases to hold that office. 320 |

520 | 520 | | (2) One shall represent a business in the Duke District that is not licensed to sell 395 |

521 | 521 | | alcoholic beverages or cannabis; 396 |
---|
522 | 522 | | (3) One shall represent Howard University or Howard University Hospital; 397 |

523 | 523 | | (4) One shall represent the owner or operator of a performance venue, legitimate 398 |

532 | 532 | | (1) One shall represent the owner or operator of a performance venue, legitimate 407 |

533 | 533 | | theater, or other cultural institution within the Duke District; 408 |

534 | 534 | | (2) One shall have proven expertise in municipal finance, business finance, or 409 |

535 | 535 | | economic development; 410 |
---|
536 | 536 | | (3) One shall represent a business or commercial property within the Duke 411 |
---|

538 | 538 | | (4) One shall be a Duke District resident that is not associated with or employed 413 |

643 | 643 | | public spaces within the Authority boundary, including residential blocks; 518 |

644 | 644 | | (9) Serve as a coordinating body for the District’s public safety and enforcement 519 |

645 | 645 | | resources within the service area 520 |
---|
646 | 646 | | (10) Pursue agreements with private property owners and the National Park 521 |
---|
647 | 647 | | Service to expand accessible public space; and, 522 |
---|
648 | 648 | | (11) Provide operating budget support to pre-existing community-based 523 |

649 | 649 | | organizations that provide services within the Authority boundary, including Main Streets and 524 |

651 | 651 | | Sec. 207. Transfers of Jurisdiction. 526 |
