21+Enclosed for consideration and approval by the Council of the District of Columbia is proposed
22+emergency legislation, the “Contract No. DCCB-2025-F -0003 with Edelson PC Approval and
23+Payment Authorization Emergency Act of 2025” and accompanying emergency declaration
24+resolution (“legislation”) to approve the award of the proposed definitive multiyear Contract Number
25+DCCB-2025-F -0003 to Edelson PC.

27+Under the proposed contract, Edelson PC will assist OAG with an investigation and potential
28+litigation against identified targets for violation of law related to past marketing, selling, and
29+installation of lead water pipes. The Contract is a multi-year contingency fee contract, under which
30+the Contractor will only be compensated if the District realizes a monetary recovery, either through
31+settlement, judgement, or otherwise.
32+The not-to-exceed amount of this contract is $85 million, and
33+the base period of performance is from the date of the award through five years thereafter. This
34+contract will definitize a letter contract awarded on October 21, 2024.

73+20 BE IT ENACTED BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
74+21 act may be cited as the "Contract No. DCCB-2025-F-0003 with Edelson PC Approval and
75+22 Payment Authorization Emergency Act of 2025".
76+23 Sec. 2. Pursuant to section 451 of the District of Columbia Home Rule Act, approved
77+24 December 24, 1973 (87 Stat. 803; D.
78+C. Official Code§ 1-204.51) and section 202 of the
79+25 Procurement Practices Reform Act of 2010, effective April 8, 2011 (D.C. Law 18-371; D.C.
80+26 Official Code § 2-352.02), the Council approves multiyear Contract No. DCCB-2025-F-0003
81+27 with Edelson PC to provide legal services to assist the Public Advocacy Division of the Office of
82+28 the Attorney General with an investigation of and potential litigation against identified targets for
83+29 violation of law related to past marketing, selling, and installation oflead water pipes and
84+30 authorizes payment in the not-to-exceed amount
85+of $85,000,000.00 for services received and to
86+31 be received under the contract.

88+3. The Council adopts the fiscal impact statement provided by the Chief Financial
89+33 Officer as the fiscal impact statement required by section 4a
90+of the General Legislative Procedures Act of 1975, approved October 16, 2006 (120 Stat. 2038; D.C. Official Code § 1-34
91+301.47a). 35
92+Sec. 4. This act shall take effect following approval by the Mayor (or in the event of 36
93+veto by the Mayor, action by the Council to override the veto), and shall remain in effect for no 37
94+longer than 90 days, as provided for emergency acts of the Council of the District of Columbia in 38
95+Section 412(a) of the District of Columbia Home Rule Act, approved December 24, 1973 (87 39
96+Stat. 788; D.C. Official Code § 1-204.12(a)). 40
