	10	+	for consideration and enactment by the Council of the District of Columbia is an
	11	+	emergency bill, the “Contract No. CW117574 with Compost Crew Inc. A Benefit Corporation
	12	+	Approval and Payment Authorization Emergency Act of 2024,” and the accompanying
	13	+	emergency declaration resolution for Mods 01 through 05. The contract is in the estimated
	14	+	amount of $4,524,736 for the period of July 19, 2024, through July 18, 2025.
	15	+	The
	16	+	legislation will approve Contract No. CW117574 with Compost Crew Inc. A Benefit
	17	+	Corporation to support organic
	18	+	waste collection f residential households in the District. In
	19	+	addition,
	20	+	the legislation will approve payment for the goods and services received and to be
	21	+	received under the contract.

14	48		To declare the existence of an emergency with respect to the need to approve Contract No.
15		-	CW117574 with Compost Crew , Inc. A Benefit Corporation, and to authorize payment
16		-	for the goods and services received and to be received under the contract.

18		-	RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
19		-	resolution may be cited as the “Contract No. CW117574 with Compost Crew , Inc. A Benefit
20		-	Corporation Approval and Payment Authorization Emergency Declaration Resolution of 2025”.
21		-	Sec. 2. (a) There exists an immediate need to approve Contract No. CW117574 with
22		-	Compost Crew, Inc. A Benefit Corporation and to authorize payment for the goods and services
23		-	received and to be received under the contract.
24		-	(b) On July 19, 2024, the Office of Contracting and Procurement (“OCP”), on behalf of
25		-	the Department of Public Works, awarded a letter contract, Contract No. CW117574 with
26		-	Compost Crew, Inc. A Benefit Corporation, to support organic waste collection from residential
27		-	households in the District for the period from July 19, 2024, through November 19, 2024, i n the
28		-	not-to-exceed amount of $1 million.
29		-	(c) Modification No. 1 to the letter contract modified the price schedule of the contract
30		-	but did not increase the price.
31		-	(d) Modification No. 2 to the letter contract extended the period of performance t hrough
32		-	December 18, 2024, at no additional cost .
33		-	(e) Modification No. 3 to the letter contract extended the period of performance through
34		-	January 15, 2025, at no additional cost .
35		-	(f) Modification No. 4 to the letter contract extended the period of performance through
36		-	January 31, 2025, and increased the not -to-exceed amount of the letter contract to $1,560,274.
37		-	(g) OCP now desires to definitize the contract for the period from July 19, 2024, through
38		-	July 18, 2025, in the not-to-exceed amount of $4,122,574.
39		-	(h) The Council intends that performance under the contract be authorized
40		-	notwithstanding the provisions of the Procurement Practices Reform Act of 2010, effective April 8, 2011 (D.C. Law 18- 371; D.C. Official Code § 2-351.01 et seq .), or any other law or order,
41		-	including provisions that would otherwise authorize protests at, or other reviews by, the Contract

48		-	(i) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved
49		-	December 24, 1973 (87 Stat. 803; D.C. Official Code § 1- 204.51(b)(1)), Council approval is
50		-	necessary because the value of the contract is more than $1 million during a 12- month period.
51		-	(j) Council approval is necessary to allow the continuation of these important services.
52		-	Without Council approval, Compost Crew , Inc. A Benefit Corporation cannot be paid for goods
53		-	and services provided in excess of $1 million for the period from July 19, 2024, through July 18,
54		-	2025.

56		-	Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute
57		-	emergency circumstances making it necessary that the Contract No. CW117574 with Compost
58		-	Crew, Inc. A Benefit Corporation Approval and Payment Authorization Emergency Act of 2025
59		-	be adopted after a single reading.
