14		-	To declare the existence of an emergency with respect to the need to approve Modification Nos.
15		-	M0009, M0010, M0011, M0012, and M0013 to Contract No. CW 101632 with KBEC
16		-	Group, Inc., and to authorize payment for the goods and services received and to be received under the contract .
17		-	RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this
18		-	resolution may be cited as the “Modification Nos. M0009, M0010, M0011, M0012, and M0013
19		-	to Contract No. CW101632 with KBEC Group, Inc. Approval and Payment Authorization Emergency Declaration Resolution of 2025” .

21		-	Sec. 2. (a) There exists an immediate need to approve Modification Nos. M0009, M0010,
22		-	M0011, M0012, and M0013 to Contract No. CW101632 with KBEC Group, Inc., and to
23		-	authorize payment for the goods and services received and to be received under the contract .
24		-	(b) On October 1, 2024, via Modification No. M0009, the Office of Contracting and
25		-	Procurement (“OCP”), on behalf of the Department of Human Services, partially exercised
26		-	option year 2 of Contract No. CW101632 with KBEC Group, Inc. in the not -to-exceed (“NTE”)
27		-	amount of $350,180.52 for the period of October 1, 2024, through December 31, 2024.
28		-	(c) Modification No. M0010 was an administrative modification. (d) On December 31, 2024, via Modification No. M0011, OCP partially exercised option
29		-	year 2 through March 31, 2025, and increased the NTE amount by $356,559.15, to $690,539.67.
30		-	(e) On January 21, 2025, via Modification No. M0012, OCP partially exercised option
31		-	year 2 through April 30, 2025.
32		-	(f) Modification No. M0013 will exercise the remainder of option year 2 through
33		-	September 30, 2025, and increase the NTE am ount by $713,118.30, to $1,403,657.97.
34		-	(g) Council approval is necessary because the modification s will increase the value of the
35		-	contract to more than $1 million during a 12- month period.
36		-	(h) Council approval is necessary to allow the continuation of these vital services.
37		-	Without Council approval, KBEC Group, Inc. cannot be paid for goods and services provided in excess of $1 million for the period from October 1, 2024, through September 30, 2025.

44		-	Sec. 3. The Council of the District of Columbia determines that the circumstances
45		-	enumerated in section 2 constitute emergency circumstances making it necessary that the
46		-	Modification Nos. M0009, M0010, M0011, M0012, and M0013 to Contract No. CW101632
47		-	with KBEC Group, Inc. Approval and Payment Authorization Emergency Act of 2025 be
48		-	adopted after a single reading.

	101	+	(g) Under section 451(b)(1) of the District of Columbia Home Rule Act, approved 43
	102	+	December 24, 1973 (87 Stat. 803; D.C. Official Code § 1- 204.51(b)(1)), Council approval is 44
	103	+	necessary since the modifications will increase the value of the contract to more than $1 million 45
	104	+	during a 12- month period. 46
	105	+	(h) Approval is necessary to allow the continuation of these vital services. Without this 47
	106	+	approval, KBEC Group, Inc. cannot be paid for goods and services provided in excess of $1 48
	107	+	million for the period from October 1, 2024, through September 30, 2025. 49
