White, Jr. 2 3 4 5 A PROPOSED RESOLUTION 6 7 __________ 8 9 IN THE COUNCIL OF THE DISTRICT OF COLUMBIA 10 11 __________ 12 13 To declare the existence of an emergency with respect to the need to continue foreclosure 14 protections for homeowners who applied for funding from the DC Homeowner 15 Assistance Fund (“DC HAF") program before September 30, 2022 and whose 16 applications remain under review, pending approval, pending payment, or under appeal, 17 and to require that notices continue to be sent to homeowners informing them of the DC 18 HAF program before a foreclosure action. 19 20 RESOLVED, BY THE COUNCIL OF THE DISTRICT OF COLUMBIA, That this 21 resolution may be cited as the “Foreclosure Moratorium and Homeowner Assistance Fund 22 Coordination Emergency Declaration Resolution of 2025”. 23 Sec. 2. (a) The Council has passed a series of emergency and temporary measures that, 24 among other things, have protected from foreclosure certain homeowners who applied for DC 25 HAF no later than 2022 and whose applications were still unresolved. 26 (b) The most current such legislation, the Foreclosure Moratorium and Homeowner27 Assistance Fund Coordination Temporary Amendment Act of 2024, enacted July 26, 2024 (D.C. 28 Law 25-212), will expire on May 1, 2025. 29 (c) As of March 2025, District legal services providers report that payment administration30 and communication issues have prevented final resolution of a small number of cases for 31 homeowners who continue to benefit from foreclosure protection. 32 (d)Emergency legislation is necessary to prevent a lapse in the law prior to the33 2 fulfillment of its purpose. 34 Sec. 3. The Council determines that the circumstances enumerated in section 2 constitute 35 emergency circumstances making it necessary that the Foreclosure Moratorium and Homeowner 36 Assistance Fund Coordination Emergency Amendment Act of 2025 be adopted after a single 37 reading. 38 Sec. 4. This resolution shall take effect immediately. 39
