 HOUSE BILL NO. 450 

   

 AN ACT TO AMEND TITLE 31 OF THE DELAWARE CODE RELATING TO A RENTAL UNIT REGISTRY. 

   

  BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:   Section 1. Amend Subchapter I, Chapter 40, Title 31 of the Delaware Code by making deletions as shown by strike through and insertions as shown by underline as follows:    4006. Rental unit registry.   (a) For purposes of this section, rental unit means as defined in 5141 of Title 25.   (b) DSHA shall establish and maintain a registry of all Delaware rental units by September 1, 2028. Landlords or property managers shall submit the information itemized in subsection (c) of this section for inclusion on the registry.   (c) The registry shall be kept current and made available to the public in a format that is searchable by all the following:   (1) Name of the landlord.   (2) Name of the property manager, if any.    (3) Address of the property.   (4) Address of the rental unit.   (5) Date the rental unit was constructed.   (6) Term of any existing lease.   (7) If the rental unit was constructed before January 1, 1978, then the following information:   a. Whether a lead-based paint inspection or risk assessment has been completed.    b. The results of any lead-based paint inspection or risk assessment.    c. Any remediation or abatement efforts by the landlord to address a lead-based paint hazard.    (d) Information regarding a rental unit and premises lead-based paint inspection or risk assessment shall be updated in the registry by the property owner within 30 days of receipt by the landlord or property manager of the results of any lead-based paint inspection or risk assessment.    (e) A lead-based paint inspection or risk assessment shall be done by a contractor who is qualified to conduct lead risk assessments for the Delaware State Lead-Based Paint Program under 2612 of Chapter 26 of Title 16.       

 BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:

  SYNOPSIS   This Act creates a rental housing registry for the State of Delaware that is searchable by the public. In addition to basic information about the rental unit, the landlord must provide the results of any lead-based paint inspection or risk assessment of a unit constructed before January 1, 1978.
