2121 Be It Enacted by the Legislature of the State of Florida: 8

2323 Section 1. Paragraph (c) of subsection (2) of section 10
2424 456.47, Florida Statutes, is amended to read: 11
2525 456.47 Use of telehealth to provide services. — 12
2626 (2) PRACTICE STANDARDS. — 13
2727 (c) A telehealth provider may not use telehealth to 14
2828 prescribe a controlled substance listed in Schedule II of s. 15
2929 893.03 unless the controlled substance is prescribed for the 16
3030 following: 17
3131 1. The treatment of a psychiatric disorder; 18
3232 2. Inpatient treatment at a hospital licensed under 19
3333 chapter 395; 20
3434 3. The treatment of a patient receiving hospice services 21
3535 as defined in s. 400.601; or 22
3636 4. The treatment of a resident of a nursing h ome facility 23
3737 as defined in s. 400.021. 24
3838 Section 2. This act shall take effect July 1, 2022. 25
