21	21	Be It Enacted by the Legislature of the State of Florida: 8

23	23	Section 1. Subsection (2) of section 489.127, Florida 10
24	24	Statutes, is amended to read: 11
25	25	489.127 Prohibitions; penalties.— 12
26	26	(2)(a) Except as provided in paragraph (b), an Any 13
27	27	unlicensed person who violates subsection (1): 14
28	28	1. any of the provisions of subsection (1) Commits a 15
29	29	misdemeanor of the first degree, punishable as provided in s. 16
30	30	775.082 or s. 775.083 . 17
31	31	2.(b) Any unlicensed person who commits a violation of 18
32	32	subsection (1) After having been previously found guilty of such 19
33	33	violation, commits a felony of the third degree, punishable as 20
34	34	provided in s. 775.082 or s. 775.083. 21
35	35	3.(c) Any unlicensed person w ho commits a violation of 22
36	36	subsection (1) During the existence of a state of emergency 23
37	37	declared by executive order of the Governor , commits a felony of 24
38	38	the third degree, punishable as provided in s. 775.082 or s. 25

52	52	4.(d) By operating Any person who operates as a pollutant 27
53	53	storage systems contractor, precision tank tester, or internal 28
54	54	pollutant storage tank lining applicator , in violation of 29
55	55	subsection (1) commits a felony of the third degree, punishable 30
56	56	as provided in s. 775.082 or s. 775.083. 31
57	57	(b) An unlicensed person who violates paragraph (1)(f) by 32
58	58	engaging in the business or acting in the capacity of a 33
59	59	contractor without being duly registered or certified commits 34
60	60	the following: 35
61	61	1. If the total money received is less than $1,000, a 36
62	62	misdemeanor of the first degree, punishable as provided in s. 37
63	63	775.082 or s. 775.083. 38
64	64	2. If the total money received is $1,000 or more, but less 39
65	65	than $20,000, a felony of the third degree, punishable as 40
66	66	provided in s. 775.082, s. 775.083, or s. 775.084. 41
67	67	3. If the total money received is $20,000 or more, but 42
68	68	less than $200,000, a felony of the second degree, punishable as 43
69	69	provided in s. 775.082, s. 775.083, or s. 775.084. 44
70	70	4. If the total money received is $200,000 or more, a 45
71	71	felony of the first degree, punishable as provided in s. 46
72	72	775.082, s. 775.083, or s. 775.084. 47

74	74	The remedies set forth in this subsection are not exclusive and 49
75	75	may be imposed in addition to the remedies set forth in s. 50
