| 28 | 28 | | chapter 921, a defendant shall be sentenced to life imprisonment 15 |

| 29 | 29 | | without eligibility for release upon findings by t he trier of 16 |
|---|
| 30 | 30 | | fact that, beyond a reasonable doubt: 17 |

| 31 | 31 | | (1) The defendant committed murder in the first degree in 18 |

| 32 | 32 | | violation of s. 782.04(1) and a death sentence was not imposed; 19 |

| 33 | 33 | | murder in the second or third degree in violation of s. 20 |

| 34 | 34 | | 782.04(2), (3), or (4); at tempted murder in the first or second 21 |

| 35 | 35 | | degree in violation of s. 782.04(1)(a)1. or (2); or attempted 22 |

| 36 | 36 | | felony murder in violation of s. 782.051; and 23 |
